Hi, i hope i can find some help...

Im a US citizen my GF is an AUS citizen.

We met in 2006 when she was a foreign exchange student here.

We kept in contact through the years and visited eachother on occasion.

I recently spent 1 year in Australia on Work Holiday visa. (10 months ago)

I left due to my fathers health to run his business while he was in recovery.

I have been receiving help from an immigration consultant
who ensured me that i could apply for a 309/100 visa.

So i have been frantically putting everything in order.

But i came across a statement saying that i had to apply
IMMEDIATELY PRIOR to our 12 month Defacto relationship...
BUT my immigration consultant told me not to worry.

I feel as though i might be getting taken advantage of
since i am paying for his assistance....

Am i still able to apply for a 309/100 visa?
Even though its not immediately prior?

Defacto is like being married without the certificate. You must challenge your agent as to why you shouldn't be worried?

Also, do you think you're in a defacto relationship? Do you share your finances, do you support eachother just like a married couple would?

I suggest you get a second opinion to review the proper strategy.

Applying for a 309/100 under your current circumstances, while technically possible, might be pushing your luck.
