Hi all,

I have been reading a lot on this forum and hope to pick your brain regarding my current situation.

I came to Australia on a student visa 573 in 2012 and have completed all but one subject, which I failed 3 times and really do not wish to continue with my program. Meanwhile I have met my husband about 18 months ago and in June this year, we got married.

We have prepared all the documents for partner visa now and ready to submit. The problem is: I have learned that if I don't enrol, then my program is cancelled and my student visa is cancelled, and then I will have to apply for the 'not so nice' bridging visa e if I apply onshore.

Even if I want to apply offshore, withdrawing from my program would lead to cancelling my CoE and my student visa. With a visa been cancelled on my record, I am not sure about the affect on my partner visa application?

But if I continue with my course, my bridging visa won't be effective until my student visa expires? That means pretty much I just put off my student visa expiry date for now, which can still be within the processing time of the partner visa.

Anyone has any idea of what should I do?

Hi, I am in a similar situation (currently going from 573 to 820)

As soon as you apply for a partner visa onshore - you will get an email with a Bridging Visa A. But it will only come in effect the next day after your student visa expires.

You must comply to student visa conditions while your BVA is not in effect.
If you cancel your program - you will break the student visa conditions and your BVA and partner visa application will be cancelled as well.

As soon as your student visa expires - BVA will take effect and you can unenrol from uni.

Just curious - how long do you have till your student visa expires (also, which uni ? :) )

Thank you so much Maroon. My current visa will expire on 12/9, which is like just around the corner! I am with UniSA doing Master of Teaching. My Uni kept telling me I am not enrolled and my visa will end soon so I need to update my CoE and visa ughhh. I feel stressed and hope Uni wouldnt cancel my program and report it to Immigrations?

How about you Maroon? Have you got your BVA in effect already from this transition?

Again, very similar situation.

My student visa expires on the 31st this month, I applied for the partner visa 3 days ago and immediately got Bridging Visa Class A.

Incidentally my census date to unenroll from uni without financial penalty is on the 31st as well, so what I am going to do now is - wait till the end of August and defer my program. This way I will not have to pay for my course this semester - and they will not cancel my student visa. So next day I am already on Bridging Type A (which has no work/study limitations and also allows you to apply for Medicare)

So what I suggest to you - you definitely need to keep your student visa 'active' until the date it expires, i.e. do anything you need to do in order for it to not get canelled before the expiration date - this often means that you need to be enrolled in uni. Can you enroll for the next semester now, then apply for Partner Visa (before your student visa expires) and once you got 1-2 days left on student visa - unenroll or defer your studies (most unis let you defer instead of cancelling program when your visa conditions change, so you can come back to study later)

And one big advice - make sure you read all the partner visa information on the DIAC website and have a look at the forms as well so you know what to expect.
