Hi,

quick facts

Offshore : India
Partner visa application : 17th April 2012
PCC submitted : 23rd May 2012
Medical: waiting to be asked as instructed by VFS
CO : still not assigned

My wife is an Aus citizen by naturalization. We got married last Feb in Adelaide and than I had to come back to India. My second application for tourist visa (applied along with Partner visa) was rejected based on the ground that I have left my job and did not inform them about getting married. Which was not true cause my wife did tell immi about our marriage before they grant the first visa. I told them that I have left my job coz I want to stay with my wife for at least three months till the partner visa gets processed and no employer would hire me and give me a three months's break. But they took the decision and then informed us without even asking about the facts. They did not even consider that I will have come back since I am applying for a offshore partner visa. And now they are asking us to apply for a tourist visa after initial assessment gets over. Which is very taxing for both of us. It takes longer time for a partner visa to process from India.
Meanwhile we are thinking of settling down back in India and let the partner visa thing take as long as it could.
But I am a little concerned here. If she comes back to India to live with me she will have to leave her job and come back. In which case, will they still consider her as my sponsor?? and process the application?
Please suggest. Now what is important for us, is to stay together which immi does n't seem to understand. For us it doesn't matter where we put up , India or Australia. But I just don't wan to leave the partner visa thing just like that since I know how much she loves her job. She wants to sacrifice her job and come back to India because its taking too much of time. She can apply for a OCI (Overseas citizen of India) to come back and live with me.

Hello Sumantaghosh,
I don't think it's a good idea if she leaves her work. As a sponsor she needs to prove that she can support you when they granted your visa.
I think, if you want to be together just apply for tourist visa again. That way she don't need to quit her job.
For sure they will still process the application. If they will grant it, I'm not sure.

I don't think it's a good idea if she leaves her work. As a sponsor she needs to prove that she can support you when they granted your visa.
Ok, this probably depends on country of origin, educational status and who knows what, but - sponsor does not necessarily need to have a secured job in AUS to be a sponsor. When we applied we were still students in New Zealand and we simply said that we are planing to get jobs once we move to Australia. This didn't make any problems.

I agree with what you said Aineko. The good advantage you have is you're studying in NZ that time. Australia and New Zealand has a good relationship. They're like bond.
By the way, what's your country of citizenship?

It's doesn't really necessarily to have a job in Australia. But its a big thing when you're sponsoring someone specially when you came from a high risk country.

That's what I felt about the issue. Though it wont be a big deal for her to get a new job there if she comes back to India for the time being, but it all changes since its India from where we are applying from. They treat every applicant here as if they are criminals or something, trying to get to Aus. I dont know much about immi but may be they are taught to deal like that. Or may be they do have some real concerns.
Just for reference, my wife is a doctor working and living in Aus for last 10 years of her life. She loves the country and never thought of coming back to India before I came in her life. As far as I am concerned, I guess, it wont be a huge issue to get a job if I get a work permit. Am an animator but I am open to change my career if needed coz I am in this business for too long now and a change will be welcome.
I still remember how they called me from New Delhi office during the processing of my first tourist visa and warned me about not working there. It was funny cause I was visiting for just 10 days. I told them, that no corporate will ever hire anybody for 10 days on a tourist visa.
It seems like they really do have generalized view of everyone applying from countries like ours. It feels bad but cant really help it.
I cannot even blame Australians for this kind of behavior since all these officers that we deal with here are Indians, not Aussies. Even, in the airport, It really felt like Indian immigration is more worried about my visit to Oz than Aus immigration. It was nice and smooth when I approached immi in Adelaide. They just asked me "What is a CG Artist" (I had that written on my passenger card). They allowed me in, just after I explained them about my profession.

Feels good that, you guys have such a good forum here for people to speak. It opens up to a lot more information and support like this. :) Thank you.

You're welcome. I do understand how you feel. It's really hard when you came from a high risk country.
The immigration is being strict because people from high risk countries are known to over staying and illegally working. It is hurtful being labeled like that. But somehow it's true. There are people who did that. But not all. But they generalized it.
It's something that we all have to deal with. Very sad. I'm from a high risk country too.
But at the end of the day, what matters most is your relationship with your partner. Don't think of what other people is gonna say.

But the best advice I can give you in your situation is, don't let your partner quit her job. You said she's been in Australia for 10 years and she has a good job. She is your sponsor. That's a proof that she can support you while you're in a tourist visa. And if they granted your partner visa, her job is a good proof that she can support you while you're looking for a job here (Australia).
