Hi,

I am an Australian citizen working abroad and I applied for a visit visa for my wife previously. We were granted 1 year multiple entry visa with a max stay of 3 months. We already went to Australia for 3 weeks and returned.

I have the following questions now as we are thinking of relocation to Australia:

1. Can we move to Australia and apply for a partner visa from there? My wife does NOT have the "no further stay" condition on her visit visa.

2. On the entry card to Australia that is filled in the plane and submitted upon arrival, we will be mentioning that we are willing to stay in Australia. Is it possible that the visa status change upon arrival and she get the "no further stay"?

Don't declare on your entry card you plan to stay permanently. You might get questions by customs and your wife could be refused entry as a non-genuine temporary entrant. Best just to write you're there to visit then apply for 820 onshore. You can explain that once you were in Australia your circumstances changed and you made a decision to apply for permanent partner visa as you would like to stay long term.

So in other words, is the 309 visa more secured?

Also if you apply for the 820 visa onshore while on the visitor visa, what are the chances that this might not be accepted? And what shall be done in this cass?
