I am applying for onshore partner visa to live with my wife of several years now. To give some context, she holds a huminatarian protection visa that was granted before condition 8559 was introduced, but then she returned to here country due to living & financial hardship and stayed for more than a year. We got married and we have been here in Australia for a couple of years now and her PR is still valid. The application is ready to go and all evidence files are ready for upload. My concern is would she be under the risk of getting her PR cancelled because of returning home or should we believe that there is noting to worry about and that I should apply for the onshore partner visa?
