Please Help Regarding Partner visa 300/100 or 820/801 ?

Hi there

I am australian citizen and looking to sponsor my partner who is off shore (pakistan). we are married but I am not sure which is the best option

Is it better if she applies from off shore (300/100) or If she comes here for a tourist visa and apply from on shore (820/801)

I would really appreciate if someone can assist me with this

It is personal needs to an extent.

Also would she get a tourist visa? and without a no further stay condition?

I understand, yeah she would be applying for a tourist visa but once if she applies for a PMV wouldn't she go on a bridging visa. The only drawback to that is she wouldn't have working rights till she gets the PMV.

I may be totally wrong here

There are 3 Partner Visa's, you seem to be getting them wrong.

Best to use this.

309 and 820 are an offshore and an onshore Partner Visa application (married or de facto)

and the PMV - this is a Prospective Marriage Visa and is only an offshore application.

You can't get a PMV, as you are already married.

Getting a tourist visa without a "No further stay" might be the big problem.
If you can, then the 820 Partner visa route is a good one. Otherwise the offshore partner visa 309.

In addition to what they've already said above, assuming she could apply for an 820/801 from a tourist visa without the "no further stay" condition, she would be granted a bridging visa A. The BVA kicks in one the tourist visa stay period expires, and then she would have work rights once the BVA was active.
