Sorry about that test post, I had posted a long one, but it said it needed to be approved by a moderator and I can't find it anywhere!

Anyway, hopefully someone can help me - i have a few questions which I've tried trawling through this forum but i'm a bit confused since there are so many opinions!

1. My partner had studied in the US from 2009 - 2012. However, it's been a while now and according to the police check fact for the US, they only provide FBI checks for people who have resided there for at least 3 months within the past year. What would happen in this case? Will we be required to get a FBI check, and if so, would it be accepted? If we needed one, I was hoping to start it earlier but not sure if it's even feasible at this point.

2. From my understanding, the online application only requires us to submit:
- colour scans of our documents, not certified true copies
- no need to provide written statements about our relationship separately. The questions regarding the finances and whatnot should suffice, but we will attach further information regarding our relationship development, proof, etc... but it will be a joint statement. Is that okay?
- we will attach at the end a statement saying that she could not remember all her entries/exits form the US to Canada since they were so often and it was such a long time ago. We will try to list down all details to the best of her knowledge.

3. For the recent changes somebody mentioned on the forum (Sorry i can't remember where I read it), it stated that they no longer inform us of missing documents and it will instead delay processing times. However, some documents such as our HK police check can't be initiated without a referral letter. I have yet to submit my AFP request as well. Should we submit it anyway, wait for the requests for medicals and police checks and submit the remaining documents when ready?

Where did you read that? I've never heard of that before and don't see it on the FBI page.

Clear color scans are fine.

Relationship statements are covered by narrative questions within the applicant's online form and the sponsor's online form.

Immigration gives a checklist and tells you to upload as soon as you can after applying. They also state that you do not have to supply police certificates or the medical at time of application as they are only valid for 12 months. And that they'll request them from you when ready. I wouldn't pay the app fee and not upload everything else straight away.

I'm not able to link things since i'm still too new to the forum, but I went through the required documents from the PMV 300 website and landed on the homeaffiars site. For the US, it states that

US temporary residents and visitors: 'FBI Identity History Summary' issued by the FBI and if you resided in the US for at least three months in the past year, a State Police Clearance for each State in which you have lived for at least 3 months during the last 12 months.
Ahh, alright - we must not have got to the sponsor's online form yet. We are still trying to fill in all the countries visited...

The sponsor online form is its own application. The applicant needs to pay and submit their application, then the sponsor can create a new sponsor app in immi and do that form.

I think you're misreading the FBI thing and not seeing the "and". US temporary residents and visitors: 'FBI Identity History Summary' issued by the FBI and if you resided in the US for at least three months in the past year, a State Police Clearance for each State in which you have lived for at least 3 months during the last 12 months.

That doesn't mean you can only get one if you've lived in the US for 3 months in the last 12 months. It means anyone who has spent a cumulative 12 months or more in the US in the last 10 years must supply an FBI background check, AND if anyone has lived in any US state for at least 3 months in the last 12 months then they ALSO must supply a state check for each state that applies. That means an FBI check AND a state check if those conditions apply. If you haven't lived in any US state for at least 3 months in the last 12 months, then only the FBI one is required.

Not true about the FBI checks! :) I just did mine and I lived in the US from 2007-2011, have not lived there since and it wasn't a problem to get my background check, they emailed it to me within 2 days! make sure you do the online option cause the paper mail option takes 12-14 weeks

Thank you both for sharing your experiences. Yep, on reading it again - I probably misunderstood that line...thank you for pointing it out!

Hopefully all goes well and we should be able to lodge our application soon!

Hi All,

Sorry - I have a few more questions which might seem silly but I'm getting so confused!!

For the applicant's form 80 Question 42, it asks about me (the sponsor) and whether I am migrating with her. I'm not sure if it counts as migrating, as I am currently residing in HK and also an Australian citizen. Should I be selecting yes or no?

For the countries visited/resided, this assumes the typical country of residence is Hong Kong right?

If she has moved around in the US a lot (coming back to HK for family visits and renting 1 year at a time), should she be listing every residential address or only the latest address?

Do you think we should simply enter a few countries visited in and ask them to refer to our supporting document, or list all the countries visited (probably over 40 entries)?
