Hello everyone!

We are just putting together our folder with my partner for subclass 820. We have been living together since October 2014, but my name is not on the lease, because the contract he had for the house was just on his name. We have a joint bank account with long and short term savings, we also have everyday expenses account that we are using all the time.
But all the bills that we actually share are on his name.
Do you think this is going to be a major issue for us? We are living like husband and wife (we own pets together, share responsibilities, contribute to our savings together etc..) So we should be able to prove it using bank statements etc, right?

I mean..if your relationship is genuine and you are living together and share everything with your partner, then the fact that you might not have the physical shared bill on paper to show them, shouldn't change anything?

I'm just worried that they are super strict and if you don't follow every rule, you don't get granted. And that's probably everyones nightmare when having a relationship with someone so far from your home country.

If the immigration officer lived with you or next door, then it would not be a problem.
But... they look at a file with all your documentary proof to help them to make a decision.
That's all they have to go on...

Ask the landlord for a letter confirming that you also lived at that address, if they are aware of that.

Explain in to your CO along with other information... highlighted and noted bank statements, mail and correspondence sent to your address. Of course there are going to be cases where couples don't have a perfect home that they both rent or own, might be living with parents or living at each other's homes in each countries so only one person is on the lease etc and IMMI know that. So just give a reasonable explanation of your life circumstances and refer to adequate evidence to back it up.

I had a similar issue (applying offshore) and decided to lodge via an immigration agent, because the whole evidence thing was such a nightmare. I have to say they have been HUGELY helpful so I would recommend this route if you can afford it. Basically my partner has dual UK/AUS nationality and he is sponsoring me. He moved from Australia to the UK to be with me and we live in my house. All the bills have been in my name for 15 years and without thinking we might want to apply for a visa, I never thought of adding his name to the bills and also if you call the utilities they won't bother adding an additional person onto the bill as long as they have one account holder. So when it came to applying for the visa we didn't have the rock solid retrospective proof other people might have in their filing systems!
The approach we took was to find a printed communication sent to us for every month for the 24 months prior to lodgement. If we didn't have a joint official letter addressed to us then we sent individual ones which prove we have both lived in the same place at the same time. The things we included were online shopping delivered to our address, junk mail sent to us both or individually (apparently if you are receiving junk mail that is considered quite good proof of residence at a given address!). Obviously bank statements etc etc.
I understand the DIBP will be looking at your case in the round, everyone is different. They need to be satisfied that you are a genuine de facto couple, not that you have ticked every hypothetical box on the exam paper.

I didn't have a lease agreement or a joint back account with my (now) husband when we applied. Just try and find as much other evidence to support your relationship and explain the situation in your stat dec.....Also if the landlord is willing to make a statement about the living arrangement even better!!
