Hello everyone I am new to this forum I applied my prospective marriage Subclass 300 from VFS India, Kolkata ( paper based ) on 4th Jan 2018.They told me that the department would mail be about my medicals.
My partner is a Permanent Resident of Australia.I know him from last 2 and a half years we met multiple times in India went to places together.

We received an email from VFS that my visa application has been received by the high commission.( note : the email was from vfs not high commission acknowledgement.)
We received No direct acknowledgement from the department.
In second week of February my partner received an email from the department asking him to provide his police clearances which he sent and they sent an acknowledgement that the documents provided is received.

It was until April until I mailed them asking about my Hap Id they mailed me that they had already mailed me (although I received no emails and although they mentioned the hap ID number with my name written with spelling mistake still I called the clinic they told that they are going to take care of it as I showed the with all my originals where my name was spelled correctly.

I applied for a visitor visa 600 and got it granted within 2 weeks and joined my partner in Australia being living with him for 5 months now.

But still got no information about the PMV not a single email from them.
It was until today I saw a lot of PMV getting granted within 3-5 months when I really got not even a single mail from them except when I received my HAP ID.
I called the department they told they cant answer any query untill the processing times have passed but they do mentioned me that since its an offshore visa and I am currently on shore I am putting myself in the risk of the PMV getting cancelled being on shore.

I always thought If PMV is granted when I am onshore I would receive a notification from department telling me to be offshore to activate my visa.

Its making me really nervous its being almost 11 months and if something goes wrong it will be mentally straining for us and also affect our long term plans for being together, being a same sex couple life a respectful and dignified life.
We waited till the Marriage Equality was legislated and making same sex couples eligible for PMV. Cause we couldn't get married in India as its illegal even homosexuality was criminalized till September 2018.

My question is

Since the almost did'nt mailed me anything for 11 months are the chances of the VISA getting cancelled more? Does visas taking more time mostly gets cancelled since they are writing reasons to cancel?

Since am onshore right now can they just directly cancel the visa without even giving me any notification to go offshore for the visa being granted.?

Since its a same sex relationship can the do any prejudice to us making our application more vulnerable for cancellation?

Do you guys have any advice for us to do? what do you think of our case ? Heard any case like ours.

We registered Defacto from NSW BDM in July 2017.

I am currently with my partner in Australia thinking to extend my visitor visa till we hear about our PMV.

The processing time has no indication on if they will grant or refuse a visa.

I have seen the embassy in India take quite awhile to grant PMV's - I remember one being around 18 or 20 months to grant. All you can do it keep on waiting.

Adress is updated contact number my partner's is given will that be a problem recentle asked again for my partner's ( sponcers )police clernce and complete discolure something one year before the asked and again they asked I am very nervous I am currently in Aus as visitor will be leaving on 26th we applied for both of our police clerence I have no idea who is our case officer and how to communicate with them to clarify properly what more documents they need. Its almost 13 months . After living together for 8 months and again getting seperated is really painfull we can't even get married in India cause same sex marriages or any civil unions are illegal in India even homosexuality was illegal till September this year. Its like i am crying inside to be with him but still can't live with him as of now don't evn know what will be the outcome of the visa.
Its very difficult to live together as a gay couple in a society or neighborhood in my country.


What do you guys think will be the outcome of visa ...

Yes we did updated out new adress at melbourne open a joined bank account infact I extended my visitor visa 600 by 2 months to stay a bit more to see the Christmas and New Year in Australia... Leaft Australia on 26th January No news on anything. Its 15 Months over.

It is all about the evidence, as long as you have the evidence then the visa is granted.

Its allready been 15 months wait its soo difficult that after starting a new life as partners with full diginity setting up our home together by our own hands and then leave everything behind without knowing will I be able to be back there even.... the only email we recived was my partner( sponcer) was asked to submit in jan 2019 was ( he was asked his pcc and afp last year in jan 2019) his pcc to every countries he stayed and afp and also complete declaration of any offence and also permission to disclose any offence to the applicant ... why this kinda mail we submitted them as soon as we got them. Its been 15 month now lodged on Jan 4th 2018 paper based so we cant even track any single progress.... we properly came out to our family our both family accepted us quit well ... our notice of Intended marriage expired on Feb 10 2019 thats makeing me an intution that they are going to refuse the visa else they woukd have grabted prior to notice of intended marriage .... whats you say on the case mish I am feeling really helpless and living with my partner for 8 months and again getting seperated for don't know how long is so sad and depressing .

Can they be more strict for same sex couples?
do you have any say on our case medical will expire on may 2019.

Heya do not stress i have been waiting 16 months not same sex but same thing happened to me. My wedding date passed early nov. Heard nothing for two months then they contacted me to pick a new date.

Also they cannot discriminate due to it being same sex. If they do deny you, fight it as if the media heard theyd be roasted.
I am craxy stressing too.. i miss my fiance and have no clue why its taking so long

That sounds odd. Many couples on the PMV are in that situation.

I always thought If PMV is granted when I am onshore I would receive a notification from department telling me to be offshore to activate my visa.

They do. We were the same and got the email to leave the country before they gave us the decision. Grant or rejection, you will be offshore when they tell you.

It is a nerve racking experience for us all.

We registered Defacto from NSW BDM in July 2017.

That bit would have me wondering, as a PMV is for engaged people. Registering is supposed to give the same benefit as being marriage. Just wondering if that affects anything, and extra checking?

I would have thought a 309 visa would be more appropriate with that.

Thanks JandE for reply we initially thought of 309 cause marriage was legalized back then but we were little taken back cause at that time in 2017 we didn't have much living together proofs so thought of wait till marriage equality is legislated and logde pmv. Can a relationship registration conflict with pmv ideals you have any Idea?

I don't know, but it is a question that a migration agent might be able to help with.

I only mentioned it as, after we lodged the PMV, I found that a relationship registration for us could have avoided the PMV and gone direct to a partner visa, instead. A relationship registration reduces the need to be living together. I learned it too late.

I applied from Calcutta in India (paper based) it is supposed to be processed from New Delhi. Austria is supposed to be low risk i guess hopefully you get your grant soon. Did you visited Australia on subclass 600.

I really can understand what you are going through we both are in same situation its soooo streesfull always living in fear i have started taking anti depressants and anti anxiety even my partner is depressed cause he is feeling very alone in Australia.
