Hi all,

I would appreciate if you could assist me by solving the following query.

My previous RRV expired in March '18. I have applied for a new RRV and still awaiting the decision as I have not completed the residency requirement. I believe it might take atleast another couple of months.

I have an urgent and emergency travel requirement back to my home country for 10 days - 2 weeks. As such, can I apply for Bridging Visa B (BVB) considering the fact that I can be back in a couple of weeks time and that it might take another 2 months before I am granted a RRV.

I was given conflicting answers by when I contacted home affairs ranging from

(a) Yes, you (PR/RRV) can apply from Bridging Visa B (BVB)
(B) PR and RRV cannot apply for BVB

I am quite confused as different answers were provided by staff members of dept of home affairs. Could someone enlighten whether I could apply for BVB as I am awaiting RRV (resident too)

Yes - but you need to apply for a BVA first on the basis of your RRV application. Once you have a BVA you can apply for the BVB.

Thank you very much Paul. I really appreciate the same.

According to Dept. website, apply for a substantive visa (includes RRV as well) constitutes applying for BVA. Here is what it mentions

You will have automatically applied for a BVA

(a) if you applied for certain substantive visas and:

An RRV is not one of the "certain substantive visas" with an automatic BVA. You need to apply separately.

Your residency status is not "cancelled' - but it does lapse if you go offshore without a holding a permanent visa. It is reinstated when/if you are granted a new permanent visa.

Another example why you cannot rely on the information on the Department’s website or “ advice” provided by its employees.

I have the similar case like yours and I was told by the Department of Home Affairs officer to stay and remain in Australia because I can't apply for BVA BVB while RRV is still being processed :(

Can you please update whether you are allowed to work on BVA once your BVA has been granted?

How did you go with your case? Have you applied for BVA and BVB?

Can you please update whether you are allowed to work on BVA once your BVA has been granted?
You can apply for a BVA on the basis of your application for an RRV. When granted, you can apply for a BVB.

If you currently hold a permanent visa and are remaining onshore, even if you have applied for and been granted a BVA, it will not come into effect as your permanent visa will not expire. If you currently hold some other type of visa, the BVA will come into effect when that visa expires and will generally have the same conditions attached, but you should check the grant letter to confirm.

This is correct. Apply for a BVA and then a BVB.

I also need to know how things went. For me, I could neither apply for BVA or BVB after launching application for RRV. The online system does not allow to do that. When I called them I was told that I simply cant do that because I am a PR.

That's incorrect 'advice'. You need to make a paper application if you want a BV for an RRV application.

I am facing similar scenario, dear post starter, can you please help? Did you get BVB? Did it affect your residency?
It will affect your status as a permanent resident if you go offshore holding a BVB.
