Hey my boyfriend and I have been living together for 4 years in Canada, He is Canadian and I am an Australian citizen. Can we apply for him to be a permanent resident in Australia from Canada for spousal sponsorship? What is the time line like as my Canadian Visa is about to expire in July is there a leu time for him to live in Australia while we wait for the process to complete? Thankyou for any help you can offer!

You have two choices for application - given the long term nature of your relationship you should go straight to the permanent visa and not have to do the 2 year wait from TR-PR

1)offshore 309/100 - unsure of current processing times however when you apply offshore,there is no facility for your partner to wait out the process wirh you in Aus unless they apply for a tourist visa (no work rights) - this visa is the less $$$ of the 2. If your partner is onshore when it comes time to grant the visa,they will need to travel out of Australia in order for the visa to be granted

2) onshore 820/801 - this one packs a punch at almost $7K AUD however does have the added advantage of coming with a BVA which will allow your partner to wait out the decision time with you in Aus with full work rights. If your partner comes back to Aus with you in July on a tourist visa to check out the country and do some travelling,as long as they don't have a No Further Stay condition on their visa - there is nothing to stop you lodging onshore

I would have a read of the partner migration handbook to give you a good idea of what evidence to submit with your application. Best of luck - it can be a daunting process but so worth it when that visa grant comes in

You should be able to apply for an offshore partner visa subclass 309/100. I'm not sure about the waiting times in Canada but in the UK it's now 10-14 months. We are now 7 months in.

In the meantime your partner could enter Australia on another visa subclass if he meets the criteria for that visa .eg. A 457 visa if he had an employer wishing to sponsor him. He would have to leave Australia for 3 days when his visa is granted as you have to be offshore.

My wife is an Australian citizen by birth and we applied from the UK. I have a job offer in Sydney which includes 457 sponsorship so will most likely enter Australia before my spouse visa is granted, I will simply transition on to my own visa once I receive it.

The application process for the spouse visa is fairly easy. I found gathering all of my evidence beforehand and scanning it in made the online element a lot less painful. You are limited to 5mb file size and 60 items (save a few spaces for the police check and in case additional info is requested). Also once you add something you can't delete it.
