Hi everyone!
I am trying to sort out how to go about applying for my partner visa and am just concerned with the potential for having it denied so I'm wanting advice on how to make it as strong as possible.

So me and my boyfriend originally met online and started our relationship around October 2017 online, we met here in Australia in December 2017 and I stayed until mid January 2018 at which point I went back to the states and got to work on my working holiday visa and getting my dog prepared to move out here (which is a costly 6 month process in itself).

I moved out here with my dog on July 30th 2018 and have been living here since. We have been staying at his mums while trying to get things sorted so we don't really have joint bills although we have a joint bank account and neither one of us have had good luck with finding jobs so its been a struggle.

I'm just wondering if our de facto relationship can have started once we were working on getting me moved out here or if it has to be from July ? We have also contemplated getting married to strengthen things but would rather wait so that we can afford the wedding we would really prefer, but are willing to if it makes a considerable difference.

Any advice would be great thank you !

Your de-facto relationship starts on the date that you have sufficient evidence that you were actually in a de-facto relationship.

Being in a de-facto relationship typically means that you have some sort of joint household, that you have combined your financial affairs to some degree, that you were recognised by friends and family as a de-facto couple and that there was a level of commitment consistent with a de-facto relationship.

Registering the relationship, if you are not ready to get married, is worth looking into.

Also keep in mind the new sponsorship requirements, which may come into force as early as April.

I applied for my 820 after living with my partner for over a year.
I thought we didn't have enough evidence back then.
No children, not married yet.
No joint lease agreement as we lived in my partner's house and my partner didn't want to supply a copy of his mortgage...(stubborn)
No joint name bills as my partners paid them on his own and he was too lazy to add my name.
We owned a dog and I paid vet bills. But I forgot to put my partner's name down on the dog registration paper so it looked like the dog was only mine.
Had a joint account which we didn't use much back then.
I had met all his family but he only met my distant relatives over here who didn't believe our relationship would last...

Anyway I went ahead to apply the visa with what I got on hand and I got 820 granted in 10 months.

So be confident and gather as much evidence as you can.

If you cant register your relationship in WA, a minimum of 12 months living together is essential.

The change is that the sponsor needs to be approved before the visa application can be lodged. If you are on a temporary visa and the stay period runs out, before the sponsorship is approved, it may become problematic.We are not sure when it will come in. Some are tipping 17 April.

If you can't register the relationship, a simple civil wedding will have more or less the same effect insofar that you won't need to meet the 12 month de-facto requirement.

You will still need to meet the overall relationship requirements though.

I can't imagine that it would be applied retrospectively. It would only apply to new applications.

Hello Alice what are the documents you submitted then when you applied your PV820? Were on the same situation, my partner is stubborn as well and I am struggling with the what documents should I submit since I don't have any. We recently got married and how long did you submitted all the documents after you lodge your visa application?

Hello Alice what are the documents you submitted then when you applied your PV820? Were on the same situation, my partner is stubborn as well and I am struggling with the what documents should I submit since I don't have any. Sorry I dont usually log onto the forum. I front loaded my application expect the medical. Got a generic email 4 months after the application requesting medical, form 80 and more evidence for the relationship. I supplied letters from both of us with same address, photos, phone call records and chat history though we were never apart, flight tickets for holidays. During the wait, invitation to my brother and his Australian visitors Visa, more flight tickets. I even supplied my ielts test result and my degree paper. Dont know why I did that lol
