Hi everyone , hope somebody can help me!
So i was notified in june by my private school in perth, that i was at risk of cancellation due to unsatisfactory course progress even if my attendance was perfect and i payed all my school fees. They did a new COE ending on the 6th of september (in 10 days) so they i could still study. I got an email today and i think they want , again, to extend my visa till probably january . Now as i don't want to be on a student visa anymore , if i refuse they might cancel my visa.
Can they cancel it a week before the visa expires naturally ? Problem is i'm ready for a de facto application and i don't know what to do , BVE is not an option for me ... thank you to anyone that will help

Your school does not cancel visas, it is only the Department of Immigration (DoHA).

Some point (my understanding) after the school notify's immigration (usually 3 x (a-b)/x days) Immigration will contact you saying they intend to cancel your visa, and will give you 28 days to respond as to why they should not.

Pretty much you will not be able to give any reason that will allow your Student Visa not to be cancelled.

At some point they may cancel your Student Visa ( there have been very limited cases they have not and have allowed another visa to be processed and granted, but not many).

So when your Student Visa gets cancelled so does your current Bridging Visa A, that you were given when you applied for the 820 Partner Visa.

That makes you illegally in Australia with no visa.

Ok so if my visa expires on the 7th of next month they can cancel it anytime even on the 7th is that right? So what should i do to not get troubles? Renew my visa and then cancel it after ( voluntary cancellation? )

Also, here is another thing that i did not understand, to be at risk of unsatisfactory course progress in my school contract you need to have not submitted or not be satisfactory on more than 50 % of assesments, i have sent all my assignements ( a few late ) and they did not even check half of them ? How do they know they are not satisfactory ?

Then I expect you will be fine.

You are now on a Student Visa, you will be on a Bridging Visa within 28 days.

Your Student visa will expire and will not be relevant after the 8th of September - An expired visa can not be cancelled.

So what you re saying is that even if the school would cancel my visa and the government will give me the 28 days timeframe to give them a reason not to cancel it ,i would be safe as i will apply before for a BVA before the 28 days end ?
I'm planning to apply on the 6 /7 th of september

I would not leave it that close to visa expiry to submit a Partner Visa application.

That site (immigration) can just drop out and go offline at anytime and for extended periods.

I would have my entire application section filled out now, and ready to submit 5 working days before Student Visa expiry at least.

It is a bit of a process to work through to hit the submit button and part with over $7,000.

Keep in mind that on the 6 or 7th you will need to pay by credit card and pay surcharge or they may not get the money in time and you may get visa less during the payment process.

** Again the school can not cancel your visa only the Department of Immigration can do that. So school advise immigration they cancelled your COE, immigration them contact you saying they intend to cancel your Student Visa and give you 28 days to reply why not. Chances are they wont even bother if you have another application in the pipeline.

** If your Student Visa expires next month why is your school talking of an extension (they can only extend the COE not the actual visa) till January?

Yep my application is ready , i have already completed the online process till the message "your application is ready to be submitted ", yeah clearly was a long process and took me almost 2 days.
I guess that the school wants me to apply for a new student visa, as my COE was already extended.
Ok so school notifies dep of immigration , then they will send me a letter saying you have 28 days etc...
My student visa will expire before the 28 days come to an end, so my BVA would be already active when immigration will check on the student ( that in the meantime is expired )
Are you an imm. Agent ?or just personal experience ?

Just had to jump a few hoops mate and spend a few bucks.

FYI if I give wrong information - all most all ways a Registered Migration Agent or other senior members politely correct me.

I never take offence at being corrected, this is serious stuff.

Your post has been viewed over 160 times, many good senior members and RMA's have read this thread.

By the way yeah let's see if any imm. Agent can confirm it or so , feels like you are right, but you know , " you never know "

If I am wrong, all I can do is buy you a beer.

I don't think that will happen, but you can buy me one!

The agents wont comment on individual cases so yo would need to rework a new post.

That only leaves you with members of the forum. I would put Mania and Sky well above what I post, I don't research anymore they are sharp.

Hello, my school already cancelled my Coe yesterday 22/02/2019 but I already have a bridging visa that takes effect on the 1st of March 2019, do you think I would be fine? As it takes 28days to give immigration a reason why not to cancel my student visa.

Your school has sent notification to immigration that they have cancelled your COE.

Immigration as far as I am aware, will still contact you and state they will/intend to cancel your visa unless you supply a reason why they should not. They normally give you 28 days to respond.

From what has been posted, you should be ok, but bear in mind that immi can make a decision on any submitted visa application at any time, without seeking further information.
