I would like to work in Australia for some years and thinking of getting a subclass 457 visa. I have a friend in Australia who runs a backpackers and scubacentre and who would love to have me work for him. He's had an assistant manager for several years, who quit two years ago. He hasn't been able to find a good replacement since. Since I'm a scuba instructor, have some experience a manager and speak several languages that can be useful in tourism and he has seen me at work and knows that I'm the kind of guy he would like to help him out, I would (from a logical point of view) be the ideal candidate. The problem is that I'm not Australian, but Dutch.

I'm wondering though if he and his business could get approval as a Standard Business Sponsor. I think most requirements for this approval and requirements for the position (as manager) and me shouldn't be too troublesome to handle. However, I wonder how he can demonstrate that this "will advance skills through technology or training". In a way teaching scuba-diving at different levels is advancing skills through training, but will immigration see it that way?

I have some experience with immigration, since my wife is Canadian and she lives with me in the Netherlands now. It's a lot of paperwork and trouble, that I'm willing to handle as long as I know that it's worth it. Would you have any idea whether or not he could get approval and any suggestions of what we could do to demonstrate the business will advance skills through technology or training?

One hurdle that would need to be overcome in the business being approved is from memory that a business has to have ten employees and if that isn't the case, probably no point in the company applying to be approved.

You could check that under eligibility with the 457 visa.

I've heard that before, but didn't see it mentioned while going through the paperwork, nor while checking for it again the last two evenings. Although the number of employees (Australian citizen/PR) has to be filled in on form 1196, I haven't seen any statement about a minimum number of employees.

Just had a quick look Grover and it could be that they have dropped the ten employees clause, not so much as an easing up of requirements but just through revamping of the complete visa eligibility wording to represent what it is hoped that a 457 visa will be all about.

The approval of eligibility for an employer and nomination of a position could even be more demanding than previously despite lack of numbers but no harm I suppose in an employer attempting it.

The booklet - http://www.immi.gov.au/allforms/booklets/1154.pdf may spell out more detail than what is on pages of the web site.

Given current economic conditions spreading around the globe, the Oz gov. has been tightening up in a number of areas re visa approvals and I would not be surprised if your friend has some difficulties.
