Hi All,

I am looking for some advice for my partner who is currently in Australia on a Working Holiday Visa 417 that ends in early July 2020. We are ready to apply for the 801/820 Partner Visa though she is looking to complete a 1 year course beginning in July 2020.

I am of the of the understanding that if we apply for the Partner Visa now, she will automatically go onto BVA in July where she won't have the rights to study for 12 months.

Therefore we are considering holding off on the Partner Visa, applying for a Study Visa 500, then once she begins her study, apply for the Partner Visa. I believe this would mean she could study for 1 year whilst her Partner Visa is processing then work on a BVA visa after the completion of her course.

We would like to begin the Partner Visa process asap, is this the most logical way to do so? Thanks for any help, visas in Australia are complicated!

Your understanding is not correct.

A bridging visa granted in association with an onshore partner visa application will have "nil conditions", so no work or study restrictions, once the BVA is in effect.

Yes, the Australian visa system is very complex. Fortunately, professional assistance is available and with good reason.

Thanks for your reply CCMS. If that is the case that would simplify our situation. I was under the impression that BVA conditions were tied to your previous substantive visa?

Many people have that incorrect impression. BVA for partner visa will have nil conditions once it is in effect
