Hi

Appreciate if you could help me with my query urgently. I need to know if I meet the four year residence requirement before applying for the citizenship application. Noting I meet other residence requirements.

Below are my dates inside/outside Australia:

First entry to Australia: 26/12/2013 – 13/01/2014 : visitor visa valid from 12/11/13 to 12/5/14

Travel outside Australia: from 13/01/2014 to 19/09/2014 : Held visitor visa valid from 30/4/2017 till 30/10/2014 : visa not used

Second entry to Australia: 19/09/2014 to 17/07/2015 – Partner visa 309 granted on 1/9/2014

Travel outside Australia : 17/07/2015 to 15/8/2015

Third entry to Australia: 15/08/2015 to 6/04/2016– Partner visa 309

Travel outside Australia: 06/04/2016 to 13/06/2016

Fourth entry to Australia: 13/06/2016 to 13/02/2017 – Partner visa 309

Travel outside Australia: 13/02/2017 to 03/03/2017

Fifth entry to Australia: 03/03/2017 to 8/09/2017 – Partner visa 309

Travel outside Australia: 08/09/2017 to 7/10/2017

Last entry to Australia: 07/10/2017 to date. – Permanent Partner visa granted on 04/04/2017.

Based on the info provided yes you are. You've held a visa for the last 4 years, and held your pr for a year, you've not spent more then the allowed time outside Aus in the last year and last 4 years.

Your version of urgent constitutes something very different from mine.

Thank you very much for your reply. My concern is that I was outside Australia from January 2014 till September 2014. 4 years immediately from now, is April 2014 and I wasn’t in Australia. Plus not sure if the second visitor visa that I had and didn’t use it, is considered as valid (since it is unused).

Your thoughts are highly appreciated.

Does this mean that my presence outside Australia from January 2014 till September 2014 is considered with no valid visa??
Would I still be eligible to count my first entry to oz in December 2013 for the 4 year residence requirement?

From April 2014 to September 2019, is the visitor visa counted as valid even if I was outside Australia?? Noting that I haven’t used this visa (first visitor visa was used in December 2013)

I may have confused things here with visa superceeding. For all intents and purposes you held a continuous visa throughout the process:

A visitor visa from 12/11/13 - 1/9/14 (all be it multiple visitor visas)
A 309 from 1/9/14 - 4/4/17
A 100 from 4/4/17 - 5/4/17 (ongoing)

I found the below from the DIBP citizenship policy document - do you think that is relevant to my situation?
Where a person was outside Australia on the day four years immediately before applying, but had previously been in Australia as the holder of a permanent visa, they may still use the day four years immediately before applying as a start date (for the purposes of being eligible to satisfy the four year lawful requirement), providing that on that day they held a permanent visa.

I don't know the answer to this.

I would suspect it will depend on if the visa is counted as terminated after the 3 month period if this is the case then you have issues - if it is still a valid visa despite not being able to be in Australia on it due to its longer validity length then you are probably ok.

I’m trying to apply online but not allowing me to proceed with the application. Getting a notification that I don’t meet residence requirement 😞 so it seems there is an issue!
