Hi there,

I'm an Australian permanent resident and my wife has got her visa 820 approved around 2 years ago. This coming March, she will be eligible to apply for Visa 801 which will convert her into a PR. We have two questions if anyone is kindly able to assist:

1. We read somewhere that the DIBP no longer contacts us about the eligibility on Visa 801 and it's our onus to put in the submission ourselves - is this true? Her 820 visa was processed and approved at the Perth Processing Centre and the CO actually rang her upon approval and told her that in two years time the case will be passed on to the Melbourne Centre when she is eligible for Visa 801 and she will be contacted by then for necessary documentations. So we were a little confused if we should wait or just put through the application this coming March.

2. Our boy was born last year and he is automatically an Australian Citizen. Should we still fill in Form 1022 to notify them about our new situation? I assume not, because we will be informing them anyway in our next Visa 801 application?

Hope some of you can clarify the above for us.

Hi the eligibility for 801 is 2 years from the date of initial application. Which means you were already eligible for 801 permanent visa on 8th march 2018.
Thanks, so that means we could have submitted an application last year. Is it too late to start doing it now?

I believe you need to lodge second stage as soon as possible with four category relationship evidence since your 820 were granted

Ok thank you for your replies. The CO who rang us told us we will be notified when the next stage is required 2 years after the date of approval so we thought it would be sometime in March this year.

Also we lodged our application on paper, could we do an online application or it has to be paper application as well? When she requested for additional information, she said we couldn't submit those documentations online and asked us to post them to her.

Ok thank you for your replies. The CO who rang us told us we will be notified when the next stage is required 2 years after the date of approval so we thought it would be sometime in March this year.

Yes You can lodge online second stage application, you need to create immiaccount for that. You can get all the info on how to open immi account on homaffair website

Hi, we applied on the 8 March 2016 but only got approved on the 3 March 2017
Not to sound overly dramatic, but you've been able to submit the second stage of your application now for over a year. You are very lucky you haven't been sent a refusal for the 801.

The sooner you supply the second stage the better. Good luck!

Like already mentioned, she was eligible for Stage 2 assessment two years after the 820/801 application, not the 820 grant. Evidence supplied needs to be since the 820 grant.

The notification had stopped being sent out for a while. It was and still is simply a courtesy reminder. There was never a requirement to need to be contacted by immigration before you could submit documents.

I would certainly get on and do it straight away. Like said, you're very lucky she hasn't had anyone look at her case yet, as you're automatically put in queue for Stage 2 processing once you reach the eligibility date.

As for the child, just add it to your evidences for Stage 2.

Doesn't matter that the initial application was by paper. Just create an immi account, select "New application", then "Family", then "Stage 2 Assessment". She'll need to complete the online form to get to the upload screen for evidences. You'll also need to do a sponsor stat dec, the link of which can be found on the website here. She'll need the application ID or TRN to proceed through the online form, which will be either on the Acknowledgment of Application Received letter from the 820/801 application, or on her 820 grant letter.

We have started the online application last night and have applied for the AFP check as well so once that comes through we will lodge the application.

With online application, once you've started your application we realized we could save our work and progress which is good given we are still waiting for the AFP. However, will IMMI start assessing your application at this point? Or they will only start assessing once you hit the Submit button?

At the PR stage, they can look at your case at any time after eligibility, so when you actually do the online form doesn't really matter (meaning delaying doing it won't stop them from looking at your case... Everyone should be doing it on or as close to eligibility as possible). You also don't need to wait for the police check to submit the online form. Just get it all done as soon as you can and upload the checks when you get them.

Hi all, just a note to say thank you for the tips and my wife and I have put in our application for Stage 2 - Visa 801 over the weekend. We have attached all necessary documentations and are currently waiting on the AFP check to come through.

Coincidentally, we came across someone who is in a similar situation as us i.e. he was advised by IMMI that they will formally write an invite him to supply more information for stage 2 but nothing has happened. And the funny thing is his case has been overdue by 2 years (1 year later than us). He actually rang IMMI to check and was advised by IMMI that as long as they have not informed and invited him there is no need to action any further.

And, we went back to our Stage 1 visa approval letter and there's actually a section which says about Maintaining a valid visa as below:

'You have been granted a temporary visa and will become eligible for consideration for the grant of a permanent visa. You do no need to make a further application for the permanent visa. Generally, applicants become eligible two years after the date of lodgement of the combined application. Shortly before that date, the Department will write to you and invite to provide further information'

Another friend of mine who went through the same process he actually received an invite from IMMI just last week asking him to supply further information. In his case, he hasn't fulfilled the 2 year eligibility yet (2 months away)

So our question is - what is really the official process? Some did receive the invite some did not even after a while (like our case). We were just a little puzzled but are all relieved to have put through our application.

Also make sure you provide enough relationship evidence in all four categories.

From early 2018, there was a period when no-one received the notifications, but this changed back again from 1st July 2018, when they began to send the emails again.

They do say:
This email is a reminder to provide further information so that the Stage 2 - Permanent Partner (subclass 801) visa can be processed.
There is no timeframe for response, however please be aware that complete applications will be prioritised ahead of incomplete applications.


Our eligibility date was May 2018, so we didn't get the email.

I got an invite from the department asking for further information for stage 2 a month before eligibility. Application was granted within 8 months

Thank you all.

We were also wondering at what point would you click the button which says - 'I confirmed I have provided information as requested'? Do we just leave that as it is since we are still waiting for the AFP and potentially if they ask for further information in the future?
