Hello,
My boyfriend and I are her in Australia from the UK on a Working Holiday visa. We are working and have luckily made a great impression on our boss (we work together). But we do not have any qualifications in our jobs roles to support a skilled migration visa. This is really bad for us because the company love us and we work our socks off!! They really want to keep us and are more than willing to keep us and sponsor us.

The other way round we think we could go is to for me to apply for a visa as a photographer (it is on skills list) which I am qualified in and have over 3 years experience in. And my boyfriend would apply as my de facto. But do I need to be employed as a photographer? Can we apply for PR from the visa we are on now?

We are very keen to know more, but cant find much on the internet and are struggling and starting to worry!

Any help would be great!!

Hi there,

I think a subclass 457 visa may be applicable to you two:

Temporary Business (Long Stay) - Standard Business Sponsorship (Subclass 457)

Take a read of all the sections, as there are certain responsibilities that your employer would have to undertake in order to sponsor you, so you need to make sure they are willing to take these on.

You could also try the visa wizard in order to get a better idea of your full options. I don't know your date of birth and other personal informaiton, so it's something you have to do yourselves:

Whilst a 457 temporary residency visa is the one that lots of employers/employees opt for in the first instance re sponsorship, it still requires the position you are to be nominated for to be on the ENSOL - http://www.immi.gov.au/allforms/pdf/1121i.pdf

In applying for a visa as a photographer, you would need to have an employer sponsor for a photography position as that occupation is also on ENSOL but not for SOL which is for inependent applications.

There is the possibility for agreeable employers to sponsor for PR and you can do that from a WHV and a minimum of three years experience is one of the eligibility requirements in that case.
There has been a new SOL announced and that is to take effect from July01 there being no Immi advice as yet on whether ENSOL will be changed and it is possible there will not for new policies favour emplyer sponsorship as top priority.

If you've not done so yet nd you have the time/age left you may want to consider doing three months regional seasonal work or WWOOF Australia to be eligible for a second WHV so as you at least have a longer period in which to secure a photography sponsorship.

Even without sponsorship it'll give you extra time in Australia and though the working situation may be fine, there is a limit on the WHV of spending just six months with an employer.
Once you have completed your first year, you could work for your current employer for a further six months.

And yes, if you get an employer sponsorship, your Bf/defacto can be listed as a secondary applicant, links on Employer Sponsored Workers (e457) - Online Applications
With a temporary residency visa, you do not need the normal 12 months relationship proof as for a partner visa or dependant on a permanent residency application but you'll still likely have to show some proof of a relationship.

Perhaps one strategy that may help is if your current employer knows someone who knows someone re a photography sponsorship for you and then he keeps at least the Bf working for him.

We didnt even realise that there were two lists- we are struggling to figure it all out!
The jobs that our boss wants to sponsor us for are on the list - the problem is that neither of us have exact qualifications or lots of experience to support our application. As far as we understood, you MUST have qualifications and experience?

And i thought that I wouldnt need an employer to apply as a photographer? Am i wrong? I thought that I could apply for residency straight from my work/hol visa...we speak english, i have a degree with experience- my BF would apply as my defacto.

So we cannot apply for the 457 temporary residency visa becuase we have no qualifications in what we are hoping to be sponsored for.

And i have to have an employer to apply as a photographer?

My b/f is 31 now so we cannot extend this visa- or we would without a doubt!

The 457 visas are not quite as regulated as the independent 175/176 in as much as having qualifications assessed etc.
Have a read on the nomination [ positions ] eligibility
Temporary Business (Long Stay) - Standard Business Sponsorship (Subclass 457)
and you'll see the http://www.immi.gov.au/skilled/skilled-workers/sbs/457occupations.pdf

And then on the employee eligibility
Temporary Business (Long Stay) - Standard Business Sponsorship (Subclass 457) you'll see that it's more a general matching of experience. qualifications and skills to the position.

If you have a look on the SOL against Photographer you'll see an N under SOL and a Y under ENSOL which means it is only for employer sponsorship.

So yep, you'll need a sponsoring employer to apply for something that has a possibility of leading to permanent residency.
