Hi everyone,

So just like the title said, my wife is currently on the 820 visa and we just lodged for her 801 last February. Last week my wife has given birth to our son, and I just wanted to know if we have to add him on to her application or let immi know that she's given birth. Been trying to research this online but can't find straight answers.

If it's an Aussie citizen, then no it doesn't need to be added to the application as it doesn't need a visa. You should still upload the birth certificate to her immi account though.

Yes, born in Australia to an Aussie citizen then the child is automatically an Aussie citizen.

The upload of the Birth Certificate is for on going relationship evidence.

The birth is a good reason not to refuse 801 on any minor doubt, as most situations now will give your wife PR options or a good MRT outcome.
