Dependant of student visa holder - how to apply from outside Australia

Hello,

My boyfriend (currently in Australia) will soon be applying for a 573 student visa and I (currently in Italy) will apply for a dependant visa once his visa is granted.

I looked everywhere on the Immi website to find information on how to apply and I only seem to find very limited info. I know it has to be a paper application, I know he has to fill a couple of forms and send them to me, but there isn't a step by step procedure, or a checklist (or I didn't find one anyway)

Has anyone done this before? Or can anyone address me to the right webpage on the immi site? Does this visa have a name?

Higher Education Sector visa (subclass 573)

I've never had this visa before so can't help you with the details, but you should be able find most relevant information on the DIBP website. Under the "Applying" tab there are checklists.

Applying for a 573 visa is rather straightforward, my problem is that I can't find instructions on how to apply for a visa as a dependant of my boyfriend once his 573 visa is approved.

I know it is possible and I know it has to be a paper application, what I'm finding frustrating is that I can only find very limited information on how to do it.

So Erikaa - this person is NOT your partner now, but WILL be your partner after you get your visa? If they ARE your partner now, my understanding is you're required to include them in the application as your partner even if they aren't coming with you. Is the situation that you are a couple but don't meet the requirements to be de facto yet, or...?

Sorry, I re-read and realized you're the partner of the applicant. If you're applying as his de facto partner, I think you'll need six months of evidence of living together, sharing finances etc. first before you can be added to his application as a subsequent entrant.

Hi CollegeGirl,

Many thanks for your reply!

We have been in a relationship for 2 years, we have bills, a lease, joint statement, photos, flights, campervan rental and much more. We should be fine proving that we are a couple.

What I am after is a list of documents that I have to include in my application. I do not want to take anything for granted. I want a list that says you have to send the following: certified copy of your passport, police check, etc.

I know what I have to send roughly, but I know how strict they can be, so I want to make sure my application is not delayed.

I'm thinking that perhaps, since I would be his dependant, on his student visa, I can refer to the same checklist as a student visa...

I'm confused - if you are already qualified to be on his 573, you should be part of his application BEFORE it's granted, not after! I'd contact the CO right away and try to get added before they grant it. If you're his de facto partner and he didn't list you as such, he's not going to be able to list you later and get you added later.

On the 573 visa page (linked above), then under Eligibility, then Family Members it says:

Declaring family members

You must declare all family members on your application, even if they do not plan to travel with you to Australia. If you do not do this, your family members will not be eligible for the grant of student visas as your dependants to join you in Australia. An exception to this is if they became your family members after your student visa was granted and before a subsequent application is made.

Thank you CollegeGirl,

He does have to list me on visa. He has to declare he has a de facto partner.

However, since he is in Australia and I am in Italy, I cannot be part of his application. I will have to lodge a separate application but there are no instructions on how to do this.

Application process
The table below outlines the three-stage process to apply for family members to join you after you have started your course in Australia.


1 Student in Australia Completes the relevant parts of the following forms.
Form 919 - Nomination of student dependants (292KB PDF)
Form 157A - Application for a student visa (669KB PDF)
Note: Student must then send the forms to the family member outside Australia.

2 Family member outside Australia
Submits the completed forms and the documentation required to our nearest office overseas and pays the application fee.

3 Our office Informs the family member that:
further information is required
or
a decision has been made.


And this is all there is online

That doesn't sound right to me - that you can't be part of his application because you're outside Australia. I'd highly suggest posting on Ask Mark! at the top of the forum - I think you need a Registered Migration Agent's input on this.
