How long can a Temporary Partner Visa stay outside Australia?

Hi All,

While searching for an answer I come across this forum and wondering if anyone could shed some light for me.

My friend she's currently holding temporary partner visa and pregnant and she would like to go back to her country to give birth as she does not have anyone close in Australia except her husband. Before making any decisions she would like to know how long she can stay outside Australia? and by staying outside Australia will it affect her application on Partner visa?

Before she makes this decision - is her husband a citizen or permanent resident of Australia? That will affect the baby's citizenship status. If her husband is a PR, and she has the baby outside of Aus, the baby will not be eligible for citizenship and will need a visa of his/her own. If the father is a citizen, it doesn't matter where the baby is born - he/she will be eligible for citizenship via descent.

If she's already taken that into consideration, it doesn't matter how long she's outside Australia on her temporary partner visa. She can be outside Australia during the whole time if she wants. Her permanent partner visa can be granted while she's outside Australia without problem. However, is her husband going to travel with her? If he's not, THAT might be a problem. She will have to provide evidence when it's time for her permanent partner visa that their relationship is genuine and ongoing, and any periods of separation were unavoidable and temporary - and I think they would seriously, seriously wonder about her being away from her husband for so long voluntarily after the birth of their child. For most people, the birth of their child is a reason that makes being together even MORE important. Just something to think about.

Applied: End of April 2014.
Visa Granted: Early July 2014.
Visa #3: 801 (PR)
Eligibility Date: End of April 2016 (Applied a month prior).
PR Granted: Early April 2017.
