Post Need Help Urgently From GSM Brisbane

Dear Sir/Madam,

With reference to the above, I am the applicant under Skilled Nominated (Permanent)(class SN) (subclass 190).

I was informed by my appointed agent that my application was denied recently based on medical assessment. However, since 22 Sept 2014 when my agent submitted the application, I was waiting for the request for medical assessment or for my file to be allocated to a case worker. Until to date, I have not received any request and so is my agent.

Upon further inquiry to GSM since it had been 3 months, my agent was notified that the application failed due to medical check.I am surprise that this happened since all the while I was waiting for the request for medical assessment.

I had not done the medical assessment as I had never received the request to do the medical check. However, email corresponds between GSM and my agent said that a request had been sent but I had not receive it and so is my agent.


Thus, can anyone assist me on what need to be done on this matter.

Thanks, appreciate very much if someone could advise me on this.

If you've appointed a migration agent to receive communication, any request for a medical would have gone to them. They're saying they didn't get any such request? I'd ask your agent for their opinion in what to do now - I'd hope they would pursue the issue with DIBP if they can somehow confirm that they didn't get any such email. Is your agent MARA registered? I'm not sure you can pursue any compensation or action, but if it was determined that your agent was negligent (mis-filed the email, overlooked it, etc.) you could file a complaint with OMARA to see what may be possible.

Unfortunately if DIBP won't offer any flexibility, I think all you can do is apply again. I'd certainly be pressing your agent to ensure they didn't charge you any further fees.

Thanks, Maggie. My agent is pursuing the matter. However, it worries me since this is their first case that such thing happened. They had done statutory declaration and sent a 3rd party IT confirmation that such email had not reached their IT server. Now they are waiting for respond.
The thing is I am reaching the age limit in May. Furthermore to reapply will take more fund for my family. There are 7 of us.
So what can I do myself to pursue on the matter with the immi. myself?
