[820/801] Aussie Police Check after 11 - 12months?

Hi,
I have been in Australia since 13th October 2010 on a 417 WHV. Sim lived with me in England for 2 weeks in February 2010 after travelling the UK together for 2weeks, (1 month in total together in UK)

I will be applying for a 820/801 defacto partner visa around the 7th of October to get as close to the 12months as possible (been in relationship since Feb 2008 online, but only met in Jan 2010 so counting on that).

I already have my UK police check all sorted, and I have read I won't need an Australian police check as I have been here under 12months, although it is only by a few days, so is this still the case?

As funds are a little tight, with them upping the cost of the visa by $500! is it best to wait and see if our CO asks for it? I also won't be front loading my medical, and will be waiting for our CO to ask for that too, as that is the way it is recommended, does that delay the visa by alot?

One more thing, how quick are they at giving a bridging visa? Is 6days before my Visa expires long enough?

Hi,

You will need to apply for the de facto visa on the last day of your WHV, the 13th October 2011. If you apply any earlier they will reject the application. You might be ok applying on the 12th but there's no reason why you can't apply on the last day, many people have done it here. Maybe the people who also did this can confirm that everything was fine.

You should apply in person and they will issue a Bridging visa on the spot, you don't have to fill anything out. My husband's WHV expired on the 13th of July, and we went to the immigration office on the 12th.

My husband got the Australian police check done because a couple days later would have been 12 months anyway. It won't take long, maximum 3 weeks.

We were intending to apply before the 13th because of the time we lived together in the UK sharing costs etc...

I think I will get the police check done and apply as close to 13th as possible to be safe, the person on the phone was pretty useless as they cant comment on individual cases, i wonder what they actually employ them for, because it appears any questions they are asked they cannot answer :S

I saw that you were living together in the UK, but if there was a substantial period of separation between your co-habition in the UK and Australia, that 12 month clock sort of 're-sets'. Were you separated after your time in the UK before you were together in Australia? If not, that's fine you can apply before the 13th, but if you were separated for a while you can't be sure that they will take the time in the UK as part of the continuous 12 months. It depends what they consider to be only a short period of separation.

I know they're completely useless when you call them, but we had a thread about this before and there were at least 4 people who applied on the last day and that was fine. Also, my husband applied the day before his WHV expired and that was fine too.

Hi,
Sorry I don't think I explained
the angle that we were going for is that we were seperated because of circumstances which is allowed on their website, ie: my work and her education, she had to be back on February 18th for year 3 of university.

But its been decided, we are going down on the 13th of October to Melbourne.

Thanks for your help.
I dont think its worth the risk of going down 6days early

That's fine. Best to apply on the last day anyway because the Bridging visa will be granted on the spot and you will have peace of mind

We applied in Melbourne too, so I can assure you it's just a simple matter of going to the office in the city, taking a number and sitting down, then you get to hand over the big pile of papers, pay, and that's it All the best!
