Ministerial Intervention

Hello Everyone,

I thought I'd share my case because I'm pretty upset right now with the outcome and the processing times of the ministerial intervention unit. I'd like to know what you guys think.I came to Australia in 2004 on study purposes,
Initially I gave my medicals which were clear for my other applications with the department i.e.2004 in student visa application ,2008 Temporary Residence and again in 2009 for Residence Visa class 885.As I always kept my health up to dated with regular checkups from my GP,hence was never advised about any signs of kidney disease till it was only diagnosed in Mid 2012 which was so shocking for me,I never in my life smoked,inhaled drugs and neither did I drink alcohol but can't understand how I can be diagnosed with such disease, as i 'm only 29 years of age with a very open mind and lots of dream to come true and never even had any bad character problems.I will be very shattered with a negative result as all my dreams and goals will be destroyed.
After finishing my study I applied for my permanent residency ,while waiting for the residency unfortunately I was diagnosed with high blood pressure and got admitted to the hospital ,I was shocked to hear from the doctors that I got right atrophic kidney ,which they told me is possibly from the birth.So I am on one kidney which is 35 percent as well.during my admission in the hospital i suffered a cardiac arrest.six months later I had second heart attack which left me with leaky mitral valve and left side of my heart was totally damaged and heart wasn't pumping well so i had to go through a open heart surgery.
In 2013 my permanent residency was declined because of my health condition.I was advised that because of my health condition they rejected my permanent residency ,I appealed against this but it was again declined.I don't have any future in India as i spent 10 years of my life here .its hard for me to go back .it will really affect my health and life.
it's just unfortunate that I have disease which came to me naturally ,while I have been spending and living my life in Australia for the last growing 10 years,I believe that Australian government should consider and give me Health wavier on the basis as an exceptional case since I want to settle in Australia and my intention of becoming a permanent citizen is legitimate I am very upset and stressed right now as there is no life or any career progression back in India since I have spent the precious 10 years of my life growing in Australia and would be very happy to live and settle my life here ..

Raj, not much good may come from ministers as I doubt if they even read your letter but hand it over to their secretary. With 2 denials im not sure what can be done on that front.
Maybe gather support from friends, people that know you or employers to set up a petition. After 10 years that should not be too difficult.......maybe someone will take up your case, like a few years ago, the wife of a Chinese doctor was to be deported on health grounds and the towns people rallied....She got her PR.....so do not just give up...try and be more pro-active.
Anyway hope it all works out.....

I am afraid the time you have spent in Australia on a temporary visa will count for naught when it comes to assessing your eligibility for a permanent visa.
The criteria for health waivers are very strict and you need to be able to demonstrate that the advantage to Australia of having you here outweighs the cost of keeping you healthy , which could be substantial.
I understand your health condition, my whole family suffers from genetic renal problems, with my grandfather dying at 45 from renal failure, and my own father and a number of my cousins being born with only one functioning kidney.
Don't blame your own actions for your condition, it is genetic, nothing you or I can do about it.

From what you have posted, your prospects of a successful application for ministerial intervention are close to nil.

Sorry to hear of your unfortunate situation, it hardly seems fair - but at the end of the day the brutal reality of policy and procedure is anything but fair. Don't lose faith or heart.

I don't know if they can help you but try a consult with either George Lombard or Peter Bollard. They are both MARA-registered agents who specialise in health issues.
