Visa 804

Hello my son is a Au permanent resident and has been there for 5 years my daughter is emigrating on the 10th of January 2012 on a 176 visa. we have a third child aged 39 who is wanting to stay in the uk and has no plans to emigrate. We have young grandchildren and really want to be with our children & grandchildren.
We can not afford to apply for a contributory visa as that would take the sale of our house and leave nothing except my pensions to live on. I was hoping the sale of our house would fund the purchase of a house near my son and can not afford it to be eaten by visa fees. I am 65 on January the 11th the day after my daughter leaves and my wife is 58.
Is the visa 804 on shore an option for us and how do I get a visa that allows futher stays so that we can apply while in australia. If it is an option would we have to stay in Australia without returning to the UK, would we both have to be in Au to apply

thanks Greg

Hi Greg,

Yah, once you pass the family test, you can apply sub 804, but your wife may be not eligible for this visa bcoz min. age requirement for woman is 63. As I know non-contribution parent visa can take up to 10 years to process, I'm not sure what should do in order to stay in Au during waiting period. Anyway, I have a friend did this visa before for his parents, let me check with him then share with you.

Cheers

Hello can I apply for the 804 while in Australia on a tourist visa e676 How can I find out if it has a no futher stay on it , it is an electronic visa added to the passport and we do not see it? Also can I do this on a 3, 6,or 12 month visa, once the application is lodged can I then return to Scotland to arrange my sale of house etc. The way I read things are that an 804 application can be used as a temporary(bridging) visa until it is processed. Do both my self and wife have to be in Australia at the time of application, I know that we must be there if and when the visa is awarded.
thanks Greg

Hi Greg,

As I know all the tourist visa has NFS condition on it, I'm not sure if it'll be addressed on visa granted confirmation letter. But if your visa doesn't have this condition, you certainly can apply onshore. Once you can lodge your sub 804 onshore, you will be granted bridging visa A which doesn't allow you to travel oversea. If you wish to depart, you have to apply bridging visa B. And general rule for visa is if you apply offshore, you have to be offshore to get visa granted, and if applying onshore, you have to be in Au to be granted.

Cheers

Hello I am 65 years old my wife is 58 years, two of our 3 children are Australian PR's Our problem is we want to be with or near them but we can not afford a contributory parent visa and I do not see the point in applying for a 103 visa that currently has a waiting list of 20 years (I would be 85 then). I was looking at the 804 visa but this has to be applied for on shore and I am in the UK. How do we get in to Australia so we can make an on shore application ? the three times we have been our visas have had condition 8503 on them. What visa would get us into Australia legally so that an 804 visa can be applied for?
I am aware of the problems with medicare and social securitie but I think we have enough income to live and my family would be prepared to help with accommodation. My apologies for repeating some questions from earlier posts.

thankyou
Gregory Black
