student to spouse

hello..
Im having a problem with my student visa, Im finishing my course this december 2011 but my visa is until august 2012.
My boyfriend and I are planning to get married on december.

The question is do I need to keep on studying (get another course) until my visa run out? or can I apply to partner visa straight away?

Hello

My husband was in the same situation. We applied for 820 spouse visa a few months after being married. You only receive the bridging visa when your student visa expires so you have to keep studying. The other alternative is to cancel the student visa. We have requested to cancel the student visa and are waiting for that to be processed. Once cancelled you have to apply for bridging visa e which has no work rights and no travel rights. You can apply to have the work restriction removed if you can prove financial hardship. So you have to way up weather you can afford to stop working in case you cant get the work restrictions removed or if it's better for you to keep studying and working 20hrs/wk.

We chose to cancel the student visa because the cost of the course outweighed how much he could earn with 20hrs/week so for u's it is financially better for him not to work.

Oh no.. another $6,000 again.. most of my classmates, their visa runs out on feb and march and i didnt know why mine is until august.. even though it not my fault?

If you apply for the spouse visa before you get married you have to prove that you are in a defacto relationship and have been living together for 12 months.

If you apply after you get married you don't need to prove the 12 months but you do have to prove you are in a genuine relationship.

There is alot involved with the spouse visa so you should should start preparing the evidence you need now. The Immi website tells you the documents you need. It is also expensive, almost $3000 for the application itself so you want to make sure you prepare a strong application.

Do you have a CoE for the course after the one you are doing now. You will have to apply for the spouse visa before the next course starts to avoid paying the course fee.

Once you have applied for the spouse visa you can request to cancel the student visa. It may be good to go and speak to someone at a student compliance officer at immigration because you don't have much time to submit the spouse visa and cancel the student visa before the next course starts.

Do what whatnext said: apply for the partner visa (make sure you meet the requirements), then cancel the student visa.
