sechedule 3 waiver

hi guys plz inform me.i got married September 2012 in au.while i lodged my application i was on bridging visa .many times my wife and me contacted our lawyer to learn what's going on he said that he can not force the department to make an decision-making of 2014 we were asked more paper works and schedule 3 and we sent all documents then we did not hear anything until updated application February 2015 .the case officer said that application has been transferred to the other team and my wife is really sick.she became a pension cause of sickness .unfortunately still waiting to hear anything .is anyone waiting over 32 months ? Please reply guys

Your lawyer is correct that he cannot force DIBP to make a decision, however I don't recall hearing of anyone waiting over 32 months for a decision. Have DIBP told your lawyer (I hope he's a registered migration agent?) what is taking so long?

It looks as if something has gone wrong here.

May I suggest that you instruct your representative to confirm your current immigration status?

Hi firstly thanks for replying. The lawyer is one of the accredited in Sydney. As I told you when I logged application I was holding bridging visa September 2012 .We asked the lawyer what's going on my application he did status update on my application on March 2014 after three weeks we received a letter that request supporting documents and schedule 3 we sent all documents also in this time my wife got really sick we sent all hospital report too . since then we didn't hear anything until we asked lawyer again to update my application on February 2015 with more hospital s report of my wife. After 2 weeks co said there has been a change application has been transferred to the other team. The lawyer said we have to wait. I m just getting worried after waiting 3 years then if I got refusal it will be frustrating. What should I do ? Contact to the lawyer again ?by the way I m still bridging visa e

If you have an accredited migration law specialist representing you, it is unlikely that you will achieve much by posting on a public forum. Your representative is no doubt aware that following a recent ruling Sch 3 compelling circumstances must have been in place at the time of application and subsequent issues, such as illness, do not count.
