Thank you very much for the tip. I was thinking of course to check properly where to send an application to before posting it; if it depends on the state one lives in, it will have to be sent to Sydney (with the courier you mentioned ).

Condition 8503

HI,

I don't know if you have submitted your 820/801 visa application or not. However, in either cases, check your current tourist visa conditions. In most cases, tourist visa has a 8503 - No further stay condition attached to it. It means you are prohibited from applying for any substantive visa while in Australia. This condition can only be waived under very limited circumstances.

if you have submitted and realise that you have 8503 attached to it, they will refuse to your application.

If you haven't submitted this application, my advice is that you leave the country first and apply for an offshore one.

Hi Jjook23,
we haven't applied for 820 yet; we're currently out of Australia we're going back to Australia in the beginning of next year. We know about the possibility that the eVisitor will have a "No Further Stay" condition; in that case we will apply for 309 which would complicate things a bit, but ... well, we'll know about NFS soon enough, in a month, so we'll know which route to take...
