461 Approved - My Story (useful information inside)

I will start this post with the most important piece of information I discovered after reading a large amount of misleading and ill-informed posts on various forums and websites and this is as follows:

There is no time scale on how long you and your NZ partner have been together in order to be eligible for this visa.

I repeat, you can be together 2 months or 20 years. This is assessed on a case by case basis.

I found this out after reading various people claiming 12 months (as other De Facto visas are) and some 6 months.

However I spent 2 hours on the phone to immigration to find this answer out after being passed around various agents I found the answer from a 461 Visa specialist whom stated the above. This is assessed on a case by case basis.

My Application (ON SHORE)

I am 24 from the UK I arrived in Australia on a WHV on 30th March 2014.

I had previously been declined a 2nd year WHV because I could not provide sufficient evidence I completed regional work. (I made this known in my 461 application)

I met my NZ partner in October, whom is 20 years old. We moved in together towards the end of October and immediately opened a Joint Bank account together in which we paid rent from.

We were sub letting a room from her mother in Brisbane, as people may raise the question, what about a lease?

I provided the following:

This was completed and signed by both my partner, I and her Mother.

We later moved to Melbourne in January, again we lived together but no official lease (rented through a private landlord) so I used a similar form as above. (This time appropriate for Victoria).

I applied for my visa around 25th March 2015, so we had been together for approx 5 months (give or take a few weeks)



Documents within my application

I followed the general checklist guide for evidence to provide:

Stat Dec from both of us and one from a friend
Copies of all documents
Police check from UK and AUS
Around 20 photos of us together
Both tenancy agreements as above
A handful of receipts from places we had visited.
I took out health insurance with Iman (they immediately sent me a digital letter to provide to immigration).
Completed copies of all required forms.
Copies of bank statements with both our names on from both addresses.

DID NOT have health check.

Select ‘Start my health declarations’

I Sent this application by post and was granted bridging visa immediately (from the date they receive the postal application NOT the date they open it, this is important as my original visa ended on the 30th March)

I received an email saying I would be assigned a case officer within a month.

4 weeks had past, no communication had happened.

I went home form work, checked my post and had a letter stating my visa was approved.

So there is a lot of misleading information out there but I found this process very simple, I stressed a lot about the visa during the time as I could not find answers to any questions so I thought I would share this to help people currently applying.

I will share this on a number of forums just so a few people can see it.

Hi,

Great news about your approval congratulations, I'm just about to apply for mine with my partner. I wondered what health insurance package you took out? E.g. The higher the cover the more chance you have of being approved?

Hi Belle,

For my 461 application,I took out a health insurance cover with HIF which satisfies DIBP 8501 condition. They provided me a letter as evidence of the same,which i sent to my CO.
