Partner visa .. Also working holiday visa pleas help

Hello everyone ,

Firstly I am sorry that I opened this thread but I couldn't find specifics answers that I really need to know .

I am dating with my fiancÚ for 2 years and I met with her at Cyprus . I born at Turkey but never lived there . I live in Cyprus ( at the Turkish side ) and j am also citizen of Cyprus . My fiancÚ's father is from Cyprus so she has relatives in here that's how we met each other . Last year she decided to move to Cyprus for me but she couldn't be happy in here because of the culture and language difference , that's why I decided to move Australia for her . And I also visited her at Australia twice . Our families get long so good . My family and her family treat us like their own kids . And I proposed her at Bali 26 th of January 2015 . We really love each other so much and as soon as we got back our countries we applied for a partner visa . We showed every documents as an evidence . Pictures , phone bills , text messages , letters and I got health examination and police check and sent to Beirut Australia embassy . By the way I applied my visa with my turkey passport which is high risk country .And from now it has been only 4 months but we haven't heard from them yet . I know visa progress takes really long , between 12-19 months I reckon . But problem is , I am about to finish my university , I study international law , but when I finish my study I do have only time till 15 th of October if I cannot come to Australia , I have to do my army duty which I really don't wanna do it because I will be away from her for a year and I am so afraid that will destroy us . Because we have been doing long distance for so long and it's really frustrated . I am sure many people have the worst situation than me but still . I really do love her and I even gonna change my home place for her . And I know I can apply for a tourist visa during this period but it doesn't give a work rights unfortunately . I'd like to ask if I can apply a working holiday visa during this waiting stage ? Would they allow me to do that ? Because I really don't wanna wait for 3 or 6 months with a tourist visa without working . I've sent to embassy many emails and I tried to call them but they wouldn't response me . Please I am so desperate and stress , could you give me some advices ?? Thank you so much .

Hi Mert,

So do you have citizenships of two countries? Turkey and the Republic of Cyprus?
There is no "Working Holiday" agreement (subclass 417) with Australia and Turkey but between Australia and the Republic of Cyprus. If you hold citizenship of the Republic of Cyprus you should be able to apply for a working holiday visa subclass 417 online.

For Turkey there is the "Work and Holiday" agreement subclass 462. On the website it says you can't apply online for this one, so you would have to apply on paper.

I remember that someone applied for a working holiday visa while waiting for the partner visa. It's just important that you tell your case officer who works on your partner visa that you are going to be in Australia (entry date) and that he/she should inform you to leave Australia when your partner visa is ready to be granted.

Hi Mert,
I think you can apply a cheap school in Australia, it just costs about AU$6,000 per year, and then you can get the student visa and have the right to remain in Australia.

Thank you for reply bee14 . I do have a citizenship of cyprus but unfortunately Cyprus separated two . The Greek side is known as the Republic of Cyprus and they are also member of European Union , but the Turkish side is only recognise by England , Turkey and Greece . It's called " TRNC- the Republic of North Cyprus " and even if I hold the passport of TRNC wouldn't recognise by Australia . So I have to apply with my turkey passport again . What is the difference between working holiday and work -holiday visa ? Only papers work ? I'd still go fine with it . But I don't know who is my case officer , once I called them and they hold me on the phone for 5 hours literally . They only told me that they received my health examination and police check because I've sent them by mail . And I tried to get in a contact with the Australia embassy in Australia but they direct to me beuirit again . Unfortunately application progress is pretty slow . I am trying to be patient but you know how human nature it is . Only problem is I am running out of a time , they might take me to army and force to do my army duty ..

I thought about that as well tobby but I've heard to apply master in Melbourne schools are pretty expensive . I didn't know there are some schools fee for 6 K . I might consider this advice thank you so much .

If you want I can help you. I am in Melbourne as well and and I am working for an education agent company. We have few schools which tuition fee is very cheap, but it is not master degree, it may just a diploma or certificate. Are you interested in it? You don't need to pay any money to us.

The main difference between visa 417 and 462 is that holders of a 417 visa can do 3 months eligible regional work in order to apply for a second visa. The 462 is only one year and there is no possibility of extension.

If you've already applied for your visa, it's quite possible you could arrive on a 462 visa and have your partner visa decided before the 462 expires. Did you apply for a 300 Prospective Marriage visa? Or have you lived together 12 months and applied for a 309 partner visa?

Oh I see the difference now . I really don't wanna come over there with a tourist visa or student visa because things will be harder for us . We lived 12 months and applied for a 309 partner visa . Thank you for replying by the way , I actually needed these advices . It's really so hard , I am about to get my diploma and having this stess in my life is really bad .

I'd love to toby , how can I get in a contact with you ? Firstly I need to discuss this with my fiancÚ and know what she thinks about this . But as back up plan it would be perfect , thank you so much for your kindness .

Hi Mert,

Before you decide if you want to apply for another visa until your partner visa will be granted, here are some thoughts:

Student visa:
- pay for the visa (roughly $1000)

- pay for your course
- you're allowed to work 20 hours per week

Work and Holiday Visa subclass 462:
- pay for the visa ($420)
- there is a limited number of visas available. I think all the visas are gone so there won't be any visas at the moment. But from 1st July 2015 there will be visas for 2015/2016 again because this is the time the government decides on the quota of visas for the coming year. So having the papers ready and applying on 1st July you might get lucky and get the visa.
WH Quota - Australian Embassy
- You can work as many hours as you want and work for one employer up to 6 months.
- There will be changes: You have to pay tax which is 32.5% on every dollar you earn and you can't claim this money back from the tax office.
