Hi,

My fiance and I had a similar situation in our application process for the Fiance visa. My fiance and I met in London (I am Australian and he is Albanian). My fiance was living in London illegally at the time we met. He was captured and detained around 6 months into our relationship and chose to go home voluntarily rather than be deported (as this looks really bad). We had become engaged on about 3 weeks prior to him being detained. I moved to Albania for 6 months when my visa ran out in the UK and then returned to Australia to await him after applying for the visa during my time in Albania.

In terms of what to provide we completed a statement informing them of the situation in the UK as he had been detained on a number of occassions during his time there. As he lived there for over 12 months we had to provide a police certificate from the UK as well as Albania. He was called in for an interview at the embassy in Belgrade that lasted about an hour and a half with most of the questions focused on his time in the UK. We provided a lot of evidence of our relationship so they weren't particularly concerned with it being genuine.

My advice is to be open and honest, admit your choices were wrong but reiterate that you are trying to do the right thing now and follow the right paths. Provide as much detail as you can and provide really strong evidence of your relationship so there is no doubt about that.

My fiance was granted his visa and is now in Australia, so it can happen

Good luck!

His application took 10 months in total but that had a lot to do with the application moving embassies half way through. When moved to the next embassy it took 5 months.

They asked him lots of questions about why he went to the UK, why he didn't leave after he had been detained the first time and other specific questions about his time in the UK.

After the interview it took 5 weeks however that was because we had to re-submit police check, if we didn't have to do that it would have only been a couple of weeks.

Good luck!
