457 - S57 Natural Justice Extension

Hi,

I hope someone is able to advise me...
I was working for a company who offered to sponsor me on a 457, the migration agent submitted their application, the nomination and my visa application at the same time. The company I worked for were refused and so I was issued with s57 and given 28 days to respond.

I have 15 days left of those 28 days. I now have a job offer from another company that are already a sponsor.

My questions are:
- Given that the date is now 21st December and we are about to go into the Christmas and new year break, is 15 days enough time for the company to submit a nomination and link it to my existing visa application?

- If I write to the CO with confirmation of my job offer, will they be able/willing to grant me an extension on the 28 days in order for me to stay in the country while a decision is being made on the nomination?

- Should I wait and respond closer to the end of the 28 days in the hope that an extension will be granted?

Any advise would be really appreciated.

An immediate email or call to immigration might not be a bad idea.

I agree with VeryStormy that you need to speak with a migration agent. DIBP is not qualified or authorized to give you migration advice about what options may be best in your situation.

What visa do you hold now? If you are on a bridging visa due to this 457 application, you will need a good agent to help you through this. There are several good agents who post regularly on this forum - look for usernames WRussell, Jeremy Hooper, CCMS and Mark Northam.

It is impossible to answer this without seeing the relevant documentation, the letter from DIBP and assessing your current visa status.
