Eligibility for Citizenship

Hello All,

It's been a while since I've been here... seems like a lifetime ago that I got granted PR! :)

I was originally granted my 820 visa in July 2011 and then my 801 visa in September 2013.

My question is the following: when will I be eligible to apply for dual citizenship? Does it count from I was granted my 820 or my 801 visa?

Any clarification on this is much appreciated.

Many thanks and have a fantastic day.

Francesco (AKA Nicki) :)

July 2011 looks like it might be your start date, but when did you arrive, and have you been in Australia for 9 out of the last 12 months.

To satisfy the residence requirements you must:

have been living in Australia on a valid Australian visa for four years immediately before applying which must include the last 12 months as a permanent resident,
and
not have been absent from Australia for more than one year in total, in the 4 year period, including no more than 90 days in the year immediately before applying.

Lawful residence means living in Australia on a valid Australian temporary or permanent visa.

Thanks for your quick reply (you guys rock)!

I actually arrived in Oz in November 2009 and have had the following visas:

Nov 2009 - ESTA
Dec 2009 - 676
June 2010 - 457
July 2011 - 820
Sept 2013 - 801

Yes I have been living in Oz continuously (apart from the odd vacation of no more than 30 days) since 2009.

So would I be eligible to apply?

Thanks again!

Nicki

Application process for Australian citizenship

"The residence requirement is based on the time you have lived in Australia and the time you have spent outside Australia.
You must:
  • have been living in Australia on a valid Australian visa for four years immediately before applying which must include the last 12 months as a permanent resident, and
  • not have been absent from Australia for more than one year in total, in the 4 year period, including no more than 90 days in the year before applying.
The Residence Requirement Calculator can help you calculate whether you meet this requirement."

I think you may have become eligible in September 2014.

I am pretty sure that a Tourist Visa is classed as a lawful visa for this residence calculator.

Does holding a Bridging Visa B while waiting to be granted the 820 onshore temporary partner visa count as lawful residence?

Be great to an answer to this!
