Partner Visa 309 - Sponsor and Partner both living outside Australia

Hello all--

I have gone through the below thread and would like to know that if there is someone from India who have got partner visa where Sponsor and Partner both are living outside Australia. Please let me know as i am still not clear whether i should apply for my wife visa or not.

Is the sponsor an Australian citizen or an Australian Permanent resident? If a permanent resident, do they meet the " usually resident in Australia" requirement ?

Hi

I am the sponsor and i am having permanent resident visa but living in india. I visited australia just to activate my pr in 2014 for 2 weeks. What do you mean by usually resident in Australia" requirement ?

Don't take this lightly. It is a requirement that must be properly addressed. See below:

Usually resident

In considering whether a relative is "usually resident" the Department of Immigration will look at where the person is physically present, the length of that residence, where they eat, sleep and have their settled home, whether the residence is lawful or unlawful and the person’s intention to make a particular country their usual home.

Sounds like you don't meet the requirements for the residency portion as a sponsor.

Yeah. I think as per the residency requirement the sponsor should be in Australia before applying partner visa. But how some people managed to apply without fullfilling this requirement and did they also get the approval?
