want to sponser someone else HELP!

Hello,
Just want to know for my friend, if he has sponsored someone a year ago and his wife was granted a visa and travelled to australia, and she was still on her TR and the marriage brokedown and she left australia and her visa was cancelled, no children just purely a relationship breakdown, divorce given certificate obtained, can my friend sponser someone else? Is there any restrictions? Is there a longer wait time? Or will it be exactly like the other sponsor process because his ex did not obtain a PR...

Any help will be appreciated...

5 year wait time from application of 309 unless exceptional circumstances (very hard to waive).

So he can not marry or sponser someone else before the 5 years? Even if his ex partner did not get a PR and has returned back to her home country?, because he wants to start his family asap, so really theres no way around the 5 year period?...thank you so much for the reply

Not for a partner visa he can't. Once the TR has been granted that is counted as sponsoring.

No, he's stuck waiting unless there are exception circumstances as Mish said.

Oh my goodness, very strict, i thought it would not apply as she did not benefit anything out of it or was not a burden on the country because of it, and would you please have any example of the exceptional circumstances please...

And would this 5 year period be from the date of divorce as mentioned on the divorce certificate or 5 years from the date of sponsorship?

5 years from date of 309 application.

The border website as examples the only one I can think of off the top of my head is long term relationship with kids.

Your friend must try to be sure this next one is the right one, as we are generally only allowed to sponsor TWO in total, lifetime.

From border.gov.au:

13. What if the sponsor has sponsored someone to Australia before?
Sponsorship limitations:
You may not be able to sponsor your partner if you have previously sponsored 2 other partners for migration to Australia; or
have sponsored another partner within the last 5 years or
were sponsored as a partner yourself within the last 5 years;

You may still be permitted to sponsor your partner in compelling circumstances, such as:
If your previous partner has died or abandoned the relationship leaving young children;
if your relationship with your current partner is long standing; or if you and your partner have children of your relationship.

Okies i guess that has put a lot of things in perspective, just wondering would the sanw rules apply if he sponsers his partner on a fiance visa and wait out the 5 year period in australia and then get married or will the same rules apply...like is there aby way around it because the non of those exceptions exist for his relationship unfortunately
