309 visa - first entry date change

309 visa - first entry date change

Hi all,
Hubby's 309 visa was granted last year with a activation date of 6 March.

We were due to fly out this Tuesday 16th Feb to Australia, however devastatingly today, I went early labour and our baby sadly didn't make it.

We are a mess and won't obviously be flying to Australia to on Tuesday.

Do you think that there is any way to request and extension of this first entry date given these extenuating circumstances?

I know immi are hardcore and don't really budge, but just wondering if its worth a shot as we still intend to immigrate and don't want to have to start again.

Sorry for your loss.

DIBP usually won't change the must enter date but you can always try. Your other option (expensive but cheaper than a new application) is for your parter to fly to Australia and make first entry and then come back again. He just needs to clear immigration so essentially could only be in Australia a few hours.

Other than that you can try with DIBP. As the saying goes ... you have nothing to lose but everything to gain.

I'm sorry for your loss.

From what I've read (I think it was in the Ask Mark thread), you need to actually miss the initial entry date, and then apply to DIBP for approval to extend it. So it sounds like you can't ask them ahead of time, and you wouldn't know until too late if they accepted your situation as a valid reason to make an exception. However I'd suggest you at least try by calling ahead and see what they say. You may need some documentary evidence from the hospital/doctor as backup.

However, be prepared to follow Mish's suggestion and your partner makes the validation trip on his own, either Tuesday or change his flight to another day between now and March 6th.

Homesickaussie, so sorry for your loss.

Hi Maggie and Mish, just wanna ensure about the short trip to validate 309 visa.. so it is totally alright if say.. I depart from my country on Monday evening, arrive in Australia Tuesday morning, clear customs, and then going back to my country by Tuesday afternoon? So less than 24 hours in Australia. Am i gonna be questioned by the immigration officers when I depart from Australia to my home country? I think this short trip trick is the best and cheapest option (considering going to the shortest distance city from my country such as Perth or Darwin) as changing the First Date entry is not possible....
