can i extend the tourist visa??????

me and my partner ( citizen) are planning to apply the defacto visa and we will apply the application in april next year. and i am going back to oz with my tourist visa to visit him until april ( becuase we will be living together for 1 year until april). however, the tourist visa only can stay for 3 months. so can i extend my tourist visa until april? if yes, can i re-enter oz after extending my tourist visa ( becuase my tourist visa will be expired in Jan, and i want to go back to my country in Feb with him together, and re enter oz again in late feb or march). so is it possible to do that?? thank you very much !!!!!!!!!!!!!!

Let me check if I understand correctly:

- you will apply for 820 partner visa onshore in April 2013
- you have a valid tourist visa that expires in January 2013
- you will be in Australia until February 2013
- you will go to your home-country in February 2013
- you will go back to Australia in late February or March 2013.

Well, it's possible to extend your tourist visa, but are you sure you want to do that? You could get a No Further Stay on your new extended visa.

Why don't you guys just leave Australia prior your visa expiring and then request a new tourist visa once you want to come back (March 2013)?

actually my tourist visa is valid in 1 year. but i have to leave and re-enter australia every 3 months.
i dont want to leave oz before my visa expire becuase my partner cant leave that early. if i leave first, i have to wait for him in my country for a month again so i want to go back to my country with him. (i know im quite troublesome )......

and what do you mean by no further stay after i extending my tourist visa and re-enter oz again?? so can i extend and re-enter oz?

thank you so much!! i m really confusing about the regulations.

sorry one more question: for the no further stay means i can extend and re-enter. but i cant request to stay longer again. so if i hand in my defacto application form after i coming back from my country again ( late feb or mar), can i still get the bridging visa??

I understand, your visa is similar to an European visa ETA and eVisitor - valid for a year, but each time you can stay for maximum three months.

And you would like to extend those three months, right?

As I know the extension is not possible, but what you could do is change your visa into a longer tourist visa, for example for a 6 months tourist visa (and you don't have to exit Australia at all).

But, considering you want to apply for an onshore 820 next year, I don't know if that's wise; what if your new - longer tourist visa has No Further Stay condition on it and then you won't be able to apply for a 820?

Info about No Further Stay: Australian Immigration Fact Sheet 52b. Waiving Visa Condition 8503 - "No Further Stay"

I hope I'm not confusing you further and you understand what I mean...

You don't have to worry about the bridging visa at all. It's all automatic, everybody who applies for a partner visa gets it - if the decision is taking longer than your original visa is valid for...

What you need to consider is how will you shuffle your tourist visa (the one that is valid until next year) and your exits, and will you apply for a new (longer) tourist visa, but with a risk of having No Further Stay condition on it...

Your Options are really very limited.

You cant waive the 3 month maximum stay condition. Being from Hong Kong, i would guess you are travelling in and out of Australia with the ETA.
You could apply for the 676 tourist visa, but i would guess you would be given the 3 month tourist visa. The tourist visa is for genuine tourists, who intend to only visit Australia. If you provide the reason of visit, to see your partner, the decision maker may see you as a risk, and would also provide you with the no further stay condition. You may be lucky, and receive a visa without a no further stay condition on it.

oh, thats really bad. i have no idea now. i think i better go back to my country and wait for him to come . or go somewhere else where close to australia ro renew my visa. sad
