Offshore vs on shore defacto partner visa

Hello everyone

I was wondering if anyone can help me with the following questions?

My partner and I have been together and living as a defacto couple in the uk for 9 years now and have started the process of filling out the Immi online form off shore, from the uk

However we are now thinking of applying from Australia instead of offshore . We visited Oz over Xmas so my partner still has a valid Tourist visa which expires in October 2016.

1. Does the existing tourist visa need to expire before we apply for another tourist visa or can this be extended?

2. Am I right that a bridging visa is automatically issued as soon as the tourist visa expires as long as we have submitted our defacto temporary partner visa( 820)?

3. Can the immi account be used to lodge an application from Australia or is the immi account only used by off shore applicants?

4. Can the "40SP Sponsorship to migrate to Australia" document be submitted via the Immi account as well or does this need to be printed and then attached to the Immi application?

4a As I am the Australian citizen who has been living and working in the uk with my partner, if we go to Australia my plan is to get a permanent job so I can start earning asap.. Is this a main requirement for me to pass 40sp criteria, I.e is financials important to pass the 40sp criteria? If I lodge an application prior to finding a job In Australia will the visa application for my partner be rejected?

5. If submitting by the partner visa by the Immi Account Do you pay for the partner visa application once you are ready to submit all of the supportingdocuments?

1. So long as no 8503 condition all good. DO NOT let it expire while you are in Australia.
2. Correct
3. Can be used anywhere.
4. On IMMI is fine.
4a. No it is more to show that you are willing to sponsor the applicant and will offer financial support while they are a temporary resident.
5. You have to pay prior to being able to upload any docs, best to get in ASAP and you have time to upload. Upload all the core docs immediately the bulk of supporting under a month if possible and continually add to it throughout the process. Note photos aren't the be all and end all, you wouldn't need more than 20 and good to use to show the relationship progressing, one couple I saw wanted to upload 2000 from a single 2 week holiday, obviously proves nothing.

Aussie83 thank you for answering my questions.
On the first question, my partners tourist visa expires in October 2016. If we end up going to Australia in September 2016 can he renew the tourist visa from Australia or does he need to come back to the uk as we basically want to be onshore to lodge our partner application and don't want to be separated.

Why don't you apply for the partner visa before the tourist visa expires? Then you'll get a bridging visa and don't need to worry about reapplying for a tourist visa.

Sure we have off thought of that and that would be our preferred method as well however we are just thinking of finances in case we are short on funds so trying cover all eventualities hence the question ?

I'm not sure of the answer I'm afraid. I think it is possible to extend tourist visas from inside Australia but they're not always granted unless you have a good reason. Maybe someone can clarify?

It might also be that if they get another tourist visa it could come with a No Further Stay clause attached which might cause issues when applying for the 820 visa.
