Statutory declaration - Partner Visa (309/100)

Hi All,
I'm new to this forum and this is my first post here.
Need an expert opnion of you guys.

I'm a PR holder and my wife is applying from offshore for Partner VISA (309/100).

My brother-in-law and sister are also PR holders and living in Australia. Since there is a minimum requirement of atleast TWO statutory declaration (Form 888) from either PR holders or Citizens of Australia.

So, I would like to ask that can I get two statutory declarations from my brother-in-law and sister as both are PR holders and will these two statutory declaration fulfill the requirement of DIBP?

Hey Alee1987,

Welcome to the forum
I think it should be alright getting the statutory declarations from your family members. I don't think there is a requirement for form 888s for the offshore applications. They are mandatory for the onshore partner visa applications.
Seniors please correct me if I'm wrong.

No worries, sorry haven't been able to give you a confirmed answer.
Waiting for other seniors to reply. We submitted 3 form 888s with our 309 but if my memory serves me right, I saw a few posts where offshore applicants were told those forms aren't needed from them and only the onshore applicants are needed to submit them.

But yeah, I'm sure someone should reply to this post with an answer

Having said that, you do need supporting statements from family and friends to support your application under the "social" category.

Many times the applicant hasn't been to Australia and don't have friends or witnesses to write them a statutory declaration thats where I remember it from. In that case, an equivalent of form 888 can be submitted like an affidavit. As only Australian permanent residents and citizens can fill form 888. Other witnesses can provide an affidavit.
My parents provided us an affidavit for both 309 and 100 applications.

In your case, you have your family who can give you the forms so you should be fine.

Just need others to confirm this.

I applied for 309 (offshore) 2 years ago and can confirm that it is mandatory to submit at least 2 Form 888's. I had a few of them done and like like Becky26 said, you could also get family and friends who are not Australian or PR to provide an affidavit.

Thanks for the reply.
So in any case, I have to submit 2 x Form 888 from Permanent Residents or Citizens.

As mentioned earlier, My brother-in-law and my sister both have PR. So if I get TWO declarations from them, will it be sufficient??

I was told as long as you have two statements from people (if you're not located in Australia) then that's fine. For us, my husband has never been to Australia and hasn't met any of my friends or family so we can't really get people to complete Form 888s as they haven't even met. We're in Russia where there isn't really any ability to write anything more 'legal' (such as an affidavit) than a written and signed statement so that's what we got people to do. We're planning on getting people to do form 888s for us once my husband is in Australia though.
