Stat Dec's question

Sorry guys I know you must be sick with Stat Dec questions...

I'm applying for de facto visa which will be submitted at the end of December just before the new pricing (*phew*)

So it's now under 6 weeks so I'm starting to get the Stat Dec's rolling.

I have a quick question regarding the rules... it states that you need 2x Stat Dec's from Australian Citizens neither can bet related to the Applicant or the Sponsor. You can also add stat dec's from relatives (pref total of 5 all up) but you need those 2x from non-reli's.

Now does this count... I have my Sponsor's Cousin's partner willing to give a stat dec who we see on a regular basis, technically is married into Sponsor's family as of march 2012. Does this count as a relative?

We also have a family friend who has known my sponsor her whole life, I know its not technically a relative but its the next best thing (she even calls the sponsor her cousin - even though its not). Does this count?

Hi Rofnac,
If not technically a relative, then not a relative. As I read it though being a relative doesn't matter, unless the rules changed recently, just better not to use relatives for the first two.

The department’s policy is that these statements be provided
in the form of statutory declarations. This form is for this
purpose. It is also the department’s policy that the person
completing this statutory declaration form:
• know both the Partner class visa applicant and their sponsor
and the history of their relationship;
• be aged 18 years or over; and
• be an Australian citizen or Australian permanent resident.
Evidence of the person’s Australian citizenship or Australian
permanent resident status must be attached to this form (for
example, a certified copy of the birth certificate, Australian
passport or passport containing a permanent visa). Such
evidence must show the current name of the person making
the declaration.
A person completing this declaration may be required to
submit up to 3 separate declarations during the processing of
the application to remain permanently in Australia. They may
be contacted by the department for further comment and
interview in relation to the information given in this form


It doesn't say they can't be relations, only that they have to be Australian Citizens or PR and that you must give certified evidence of their Citizenship or PR status.

They prefer independent people, but the more the merrier, we submitted four in our case from neighbors, none from relatives. If they want more evidence then we will ask the relations to submit some too.

Unless there was a recent change in the rules you would be fine submitting with the people you have and see if you can find some extras for later if they ask for more evidence. It is more important to get the ball rolling on the application.

I also found this page which I hadn't seen before, so I wonder if it is new.

It is for you and your partner's statutory declarations. We didn't use this form, we just created our own and had a JP sign off on it.

Thanks very much for your answer, I've read so many conflicting rules its confusing.

Regarding that personal statement stat dec, I have never seen that before! According to the Partner Booklet you don't even have to get the personal statement in a stat dec, normal writing paper and signed by applicant and sponsor would suffice.

I wonder if they are changing the rules :/

No the personal statements were as far as we know always supposed to be stat decs not just signed statements. We didn't find any form for them and used the New South Wales stat dec format.

It should be the commonwealth stat dec form not the state. We used this one: http://www.ag.gov.au/Publications/Do...rationform.doc

Hi all
Ive just submitted my PMV 300 with 4 Stat Decs and 2 letters from my family, a friend in Australia has now eventually decided to send hers (we got fed up of waiting). My question is can I submit it when it arrives.
