Applying for 189 after being on 457 with different occupation code(Same ICT Group)

Hi Experts,

I am getting the Visa for 457 that i will be getting in like 20 days will be on 261312 Developer Programmer, done by my employer and i will be travelling to Australia in a month or so.

Whereas my application EOI for 189 is using 261313 Software Engineer 65 points, expecting invite end of this year or start of July. I will be applying for PR once i am in Australia.

Both have almost same roles and responsibilities, around 95 %.
So later when i want to apply for 189 after i get my 457 at the end of this month, will there be an issue due to different occupation codes?

Any idea based on your experience?

No, there won't be. DIBP considers them closely related occupations as the same first 4 numbers in the occupation code. This is spelled out in the policy advice manual used by all case officers and migration professionals.

If you meet the criteria for a 189 visa (positive skills assessment, at least 60 points, Competent English, etc.) you can apply under any occupation code.

Applying for 190 after being on 457 with different occupation code

I have applied for Victorian state nomination (application still pending). During this time have also secured a job and on a company sponsorship and have since received our 457 visa.

The outcome of the Victorian state nomination is still pending due a backlog in the processing of ICT applications.

My successful skills assessment and application for the 190 visa (state sponsorship) is under ANZSCO code 135112 (ICT Project Manager). The 457 Visa was granted under ANZSCO code 261112 Systems Analyst.

We are expecting the approval of the state sponsorship fairly soon and would therefore like to apply for our 190 visa as soon as possible, in order to enjoy the benefits of permanent residency. My question is thus as follow:

Would it be an issue to apply for the 190 visa under code 135112 (for which I will have a successful state sponsorship nomination and skills assessment), even though the 457 visa my company applied for and which was granted is under code 261112.

We have not arrived in Australia yet, but I cannot think this will influence the outcome.

I'm currently on a 457 visa under Software Tester 261314 (CSOL) and would like to apply for 189 under under Software Engineer 261313 (SOL)

Hi,

I am in the same boat. Did you get your 189 successfully.

My occupation under 457 was 313112 (ICT Customer Support officer) which was incorrectly done by my employer, may be they wanted to pay me less money that's why. Now, I have got the positive assessment from ACS under 261313 Software Engineer with 2 years deduction.

Have submitted EOI for 189 at 65 points and 190 at 70 points. To be on the safer side, I haven't claimed the points for 1 year of AU experience because of different occupation under 457. I am currently in Melbourne only on a 457 visa.

Would this create any problem.

EOI 189: Submitted on 28-July-2017 at 65 points.
EOI 190: Submitted on 29-July-2017 for NSW at 70 points.
Note: Not claiming 5 pts for AU Experience because of different occupation under 457.

Hi,
I am on 457 VISA for last 1 year as ICT-Project Manager. Please let me know if I am eligible to apply PR under ANZSCO code as ICT-Software Engineer. I mean can I claim the 1 year experience in Australia if I apply under different code. Appreciate your quick response on this.
