Has anyone successfully registered their relationship in NSW when one of the party was previously married but separated for a long time? In the Philippines, there is no divorce and annulment is a long process.

You have to sign a Stat dec about your current situation. If you are still married for example and said on the stat dec that you are single, or divorced, or whatever else you want to call it, potentially you may have supplied a false stat dec.

I am not sure what checks they do, as you are still legally, under Federal law deemed to have a de facto relationship if you live together, even if married to someone else.

Registering a relationship is a State or Territory law that will recognise a relationship between two people, issue a certificate to prove that you live together as husband and wife. It can be very hard at times to prove to agencies that you are indeed living together.

The penalty of registering a relationship with one still being married could be

Make a false declaration

You could not be charged for bigamy as under Federal law you are legally recognised together, even still married to someone else.
