CO requsted experience to match ACS assessment

Hi

I got a replay from my CO saying she noticed my experience is not matching ACS recognized work experience . ACS give me 7 years while I have about 10 years .. I the application I listed all my experience , will they reduce my experience o be ACS recognized only and would that be an issue

Depends on other aspects of your visa application - this usually happens because ACS substitutes some of your years of experience in place of some sort of an educational qualification. If this is a points tested visa, and if the change causes you a loss of points, it could be a problem if your invitation was based on those points.

I have applied for an EOI which was selected, then applied for Skilled Sate Nominated visa subclass 190. I have checked my submitted EOI its not ask for no. Of years but asks to list employment history, the visa application asks as well to list employment history not the ACS recognized period only .

If the loss of the 3 years means you would score fewer points, you have an issue to resolve. You need to determine exactly why ACS did not recognise those 3 years before you respond to the case officer. Depending on the reason ACS did not recognise these, you'll need to try to remedy the situation with DIAC. Depending on the circumstances you may need to fight to have the 3 years recognised by DIAC, fight to have the 3 years recognised by ACS, or if both fail potentially withdraw the application, decline the invitation, and re-lodge your your state sponsorship and/or DIAC application with the proper points if you cannot appeal the 3 years not recognised by ACS.

The problem is that if the actual facts of your application don't match the points you claimed/were awarded when you entered your data into the EOI, that means your invitation was based, essentially, on inaccurate information.

The problem is that if your points value reduces as a result, it can throw off the entire approval process. You might get lucky and the state will be flexible about all of this and it can be resolved without a lot of hassle. Whether employment qualifies for the points test or not is not always a simple thing, and I can't tell you how many EOI's I've seen go wrong because of this type of issue. There are a myriad of rules that determine employment eligibility and other aspects of the points test - sometimes visa applicants are at a big disadvantage because the case officer knows all the rules, and the applicant often knows only a few. I'm not here to promote myself, but I would suggest you consider professional assistance depending on the circumstances about the 3 year issue - you may be in a position to need to appeal to ACS, the state skilled authority and/or DIAC depending on the specifics.

Thanks very much Mark for the detailed response.

I have check my EOI the 3 years difference will not change my score as its ACS approved overseas experience is more than EOI requirement ( ACS approved 7 years for me, EOI selection was 5years and less than 8 years ).

So I guess my issue now is correcting this information to ensure consistency with ACS result, the confusion was that the question request all experience not ACS recognized only experience .

Hi Hope4All ,

How did this pan out for you ? I am in the same situation because ACS has changed the way they print out result letters . My experience starts from August 2008 but my letter states "The following employment after october 2010 is considered to work at an appropriately skilled level and relevant to 261313 (software engineer) of the ANZCO code"
and all my experience is listed after the above statement chronologically .

Can you please help me out here , as I am really confused how to proceed .
