partner visa 5 years restriction help!!!

G'day

I need some advice regarding the partner visa application. I have 5 years restriction to sponsor a partner visa. My current restriction will end on 2nd week of December 2016 ( after 5 months).

I need to sponsor my new partner after our marriage. I don't have a strong reason to get this condition waived like a child or death of previous partner but I am sure stressed about it becaouse my partner is offshore.

My question is, What if I apply for partners visa now with out any waiver because Partner visa processing time is more then 9 month and after 7-9 months when our visa application will accessed by immigration my 5 years restriction will be finished.

please advise if that a right idea to lodge application earlier?

I cannot wait to have my partner with me, so stressed... please pass on some suggestions........appreciate that

There is a possibility that they will look at the application earlier and it will be rejected due to the 5 years. DIBP can look at the application at any time. It is risky lodging before the 5 years.

one more question, what if immigration see this application just after end of my 5 years restriction, can they still go negative and reject the application? even the restriction will be ended by then ....

As long as the decision is made after the restriction expires that is okay.

Not that I know of. They would have been announced and implement by now if there was a fee increase.
