Astralian Study Requirement Points - Urgent Help - Please

Hello friends

I am new to this forum. I need your help. I am applying my PR as a Social Worker in NSW and I am claiming 5 points for ASR. I have done 104 weeks masters degree from Australia. However, My Australian Study is totally different from my nominated occupation. Can I claim 5 points towards ASR.

Yes a 104 week Masters (registered under CRICOS) completed at an Australian institution over two academic years satisfies the Aust Study Requirement irrespective of whether the qual is related to your nominated occupation. Hence this earns 5 points.

If the Institution is based in a regional area then this earns an additional 5 points.

Thanks for your reply.

However, as per immigration website it should be relevent

But in Migration Regulation 1994 nothing is mentioned about relevancy

MIGRATION REGULATIONS 1994 - REG 1.15F Australian study requirement

which one to believe.

MIGRATION REGULATIONS 1994 - REG 1.15F Australian study requirement
which one to believe.



I agree with your assessment.

I've scoured the relevant Legislation and there is nothing that requires the study be related to your nominated occupation in order to satisfy the points awarded under either (or both):
Sch 6 Part 6D8.1 Australian study qualifications (5 points) or
Sch 6 Part 6D.10 Study in Regional Australia or low-population growth metro area qualifications (5 points).

In addition Section 33 of the relevant Policy Advice Manual (Sch6D - General points test for General Skilled Migration visas mentioned in subregulation 2.26AC(1)) confirms that the qualification can be unrelated to the nominated occupation.

You can claim the study (and the points) as long as the study was completed while you were lawfully in Australia.

Unfortunately there can be errors on the DIBP website and associated publications (eg Partner Visa Guidelines). I'll bring this one to their attention.

Hopefiully as you develop your EOI in Skillselect it will correctly calculate your score. If not, please bring this to the attention of the forum.
