Bottom line: you need to get the marriage annulled in the Philippines before applying for the PMV, as the PMV will be processed in the Philippines and won't be approved with an existing Philippines marriage on the books there. Sorry, wish I had better news!

Best,

Hi Ruby
Sorry Mark
I think you misread this one. How I read it was the Aussie citizen (by birth?) had previously married a Filipino in PH came to Aussie on a visa 309 and they got a divorce in Australia (assuming the Filipino had gained permanent residency). If this is the case then there is nothing stopping Ruby coming to Aussie land on a PMV300.
Though if the Aussie guy is a Filipino as well, then things would be different as you suggested. So it will be interesting to see how this one plays out

Hi Aussieboy07!

Thank you for your clarification... Mr. Mark Northam's reply freaks me out! well anyway, yes, my fiance is an Aussie by birth and used to be married to a Filipina here in the Phils and they got divorced in Australia year 2012. Unfortunately, their marriage is not annulled here as yet. And i am Single and never been married.

Thank God that it won't stop us getting married in Australia... thanks for shedding us light through that matter. But still, we gonna do some checking and clarifications in the immig for our guidance.

Thanks, thanks so much Aussieboy!

Hi Rubi
I am a Aust born citizen who married a Filipino in PH 11 years ago, we later divorced in Aust like your partner. I subsequently met another Filipino lady in PH who is now in Aust on a PMV300 and we are getting married in Australia in 4 days time. You will here a lot of people say that marriage in the PH has to be annulled but it is not true. Remember at the end of the day you are lodging paperwork to the Australian embassy who recognize divorce in Australia
