Smile Including offshore applicant in onshore subclass 189

hi everyone
my name is sherry.
i used to live in melbourne before and left the country in 2014 after withdrawing my MRT file. i was under pic 4020 and there was 3 years ban which is over in 2015.
my fiancee is there and we are in relationship from 7 years and we have tons of proofs and she is about to apply subclass 189 visa.
so just want to confirm
1. Is she able to include me in her application as i am offshore now.
2 As i had 3 year ban before . does it make any difference to the application.
3. if she can apply then what type of visa will be granted.


or i we should wait for her Permanant and then apply for partner visa as it is more time consuming.
please help.

If you are in a defacto relationship then you can be included on in his application. Being a fiance is not enough. It must be a marriage-like relationship. This means it has to comply with the definition of a de-facto relationship given in Section 5CB of the Migration Act (1958),

The fact that you had a 3 year ban that is already finished should not make any difference.

You would be granted the same visa as your partner.

and also we are planning to get married before the application. so just want to ask it that applicable if we get married just before the lodge of application.

Just include your marriage certificate and all evidences to show your relationship, and you should be good.

one more thing if you can help with that
she already got an invitation from the department. so its that ok if she can come to me and we get married and then include me in the application. is that makes any difference that we get married after the date of invitation.

I'm not sure. I'm trying to remember if it asks about including a spouse on the EOI submission. Mainly, I believe it's when the application is lodged. Maybe someone else can chime in and verify that for you. My partner is Australian, so I wasn't including him when I originally planned to lodge the 189.
