801 Permanent Partner Visa - Police Check & Migration Agent Query

Hi all -

We applied for the 820/801 onshore partner visa(s) in late July 2011 and were granted the 820 temporary visa in March 2012. We will be eligible for the 2nd stage this year, so I have a question regarding police checks. I am aware that they will send you "a list", but I am asking the question of people who may have already been through this and know what things are typically asked for in the 2nd stage.

I have not travelled outside of Australia since applying for the 820/801 in July 2011 - does this mean that I will only be required to submit an Australia police check instead of an American one (I am originally from America) as I have not travelled to America since applying and already submitted my FBI check with the first stage?

My second question is regarding my migration agent. I appointed him formally as my agent for the first stage, but he will not be representing me for the 2nd stage. Do I need to submit a form to "cancel" him as my authorised recipient/migration agent or will DIAC automatically send the 2nd stage information to me and not to him? He advised me that he had only signed the form for the 1st stage and that I did not have to submit paperwork, but it doesn't seem quite right to me.

Hi Kreuzfidel I submitted my 801 visa application just over a month ago. Here is the info you require -

American police clearance - I tried to find the specific and correct info for you but I cant seem to remember which form it was on. Basically even if you went back to the US but you never stayed there for an x amount of months. it could be 12. Then you do not need to provide a Police clearance from America again. Only an AFP clearance would be needed.

I had the same issue. My agent wanted to change me over a thousand dollars to do my second stage for me. I knew all a long I wouldnt be using him for my second stage and unfortunately my documents got sent directly to him. Then the papers were lost between him sending them to me in NSW from Queensland. I would suggest submitting the necessary document (cant remember the form number) to let immigrations know you are doing your 801 visa yourself.
