After granting of the Prospective Marriage Visa 300

Hi there,

My partner was just granted his prospective marriage visa (March, 2013) and we will be married here in Australia in June, 2013. YAY!! :)

So I'm just wondering how long should we wait after getting married to lodge the 820 onshore partner visa application?

I realise we will need enough time to gather more evidence about our new lives together in Australia but I'm cautious about waiting too long as the current estimate for the 820 visa is 15 months in NSW.

Also will we have to resubmit the massive amounts of evidence we submitted to gain the prospective marriage visa? Or just the new evidence since then? We've been together for almost 9 years so you can imagine we have a lot of evidence.

Re: how long to wait, best to make sure you have sufficient evidence living together in Australia post-marriage - many people choose 3 to 6 months of living time prior to lodging a partner visa.

Re: evidence - yes, new decision, new application package, new evidence package, can be much of the same evidence you used for the PMV plus updated statements and new living together evidence.

In your expert opinion, do you think the PMV offers any advantages when it comes to the decision of the 820 visa? For example does the DIAC need to investigate all the background information that the applicant had already submitted in the PMV application?

I'm just hoping that the smaller cost of the 820 visa for PMV applicants ($995) reflects less work necessitated by the DIAC and therefore quicker processing.... I suppose I'm just dreaming :rolleyes:

Thanks for the kind words!

I would expect that DIAC may rely to some extent on the processing done on the PMV when the couple applies for an onshore partner visa, but that doesn't change the need to submit complete evidence with both visa application packages.

I haven't heard of any statistics showing the onshore partner visa processing times are any faster when there is an existing PMV visa than not. Sorry, wish I had better news for you!

Bottom line: prepare great application packages and the chances of your visa going through successfully/more quickly may be higher. By the same token, incomplete or poorly prepared application packages means the chances of refusal will be higher.
