Visa subclass 885 validity

Hi Guys

I have a query and it would b appreciated if someone can help m.

I applied for 885 in Aug 2012 with competent IELTS score nd submitted my proficient IELTS score next month. As I appeared on 2nd sep, will DIAC consider mu application or co will refuse it straight away
Plz advise?

Hi Sam -

Can you be more specific - did you get 6 or better on all 4 bands of the IELTS test you submitted at the time of your 885 application?

Hi Mark,

when I applied on 22aug I had 6 each and on 1sep I appeared on another test which I managed to get 7 each and I later submitted this score as well.

Thanks, Sam. If you had an IELTS score of at least 6 on all bands as of the date you applied for the visa, and that test was not more than 3 years old, I would think you satisfied the competent English requirement for the 885 visa. As the 885 is not points-tested, getting a higher score (all 7's or higher) doesn't benefit you for this application. So I'm confused - why do you think there might be a refusal...?

Thanks a lot Mark you gave me but of hope. I think of it because of recent reversal of benguluru case as of june 2011 and it is so hard to understand?

Hi Sam -

The Berenguel case, now reversed, allowed submission of IELTS test results after the visa application. Now that the legislation has been changed, the IELTS test must have been completed prior to applying for the application.

But I'm still trying to understand your concern - if you completed the IELTS test prior to application and got all 6 or better scores, I'm not sure what the concern is...?

My main concern is that I hsd 6 each at time of lodgement and scored 7 each after that. I cant understand the current rule: Shd I have 7 each during time of lodgement to get 15 points or I cant provide it later before allocation to CO?

I completed Welfare worker in nov 2009 and applied for 485 on dec 2009. so, my application comes under transitional arrangement. As my occupation to apply for 885 comes under SOL schedule 2B& 2C, thts why it is a point tested visa.

Ah, now I understand what you were referring to earlier.

So it sounds like you're trying to determine whether, given the time you applied, you fall under the Berenguel precedent where English test results provided after application are still considered?
